Hi all,
Good morning, I am from India now in UK in tier 2 dependant visa. My husband is in tier 2 general visa which is valid until 2019.

Recently we had a baby born in UK and we are in the registration process, now due to some circumstances we need to travel to India immediately. So can you please let us know if it's possible to travel to India with Indian passport alone and can we apply visa from India to come back to UK for our little one.

1) can we travel to India and get visa for baby there?
If yes what are the disadvantages in doing that(because I have seen ppl getting a visa and then only leaving the country)
If no how long does priority visa take..

Hi,

We have planned to travel to India in 30 days, is it possible to apply visa n get biometric done for my baby (Tier 2 PBS dependent child).we have all the documents ready.

1)In case of priority service and normal service what's the approximate time span
I) For the application to be processed to know
the result.
II) To do biometric
III) To get back the passport
IV)To get BRP card

So based on this I can go for either priority or normal service. We just need the passport to be returned, My husband can collect visa and bring to our home country.

2) Another query is
I) How long can I stay in India, if I hold PBS tier 2 dependant visa.(I am in maternity leave at the moment)
II) If I extend my number of days in India ll it affect my ILR?
I can get ILR in 3.5 years so if I exceed my stay do I need to start my visa from first for 5 years.My husband will get ILR in 1.5 years.

1. You can apply in person for same day decision, costs an extra £590. You can also apply for the visa in home country.

2. There is no absence limit for PBS Dependents and you should return before your visa expires.

The baby does not need a visa to leave UK. Hence, you can travel back to India just with the baby's passport. You can apply for the baby's visa in India since he/she cannot come back without a valid visa.

I don't see any drawback except for the processing time. The time will depend on when you get the VFS appointment and the current workload of the BHC your application goes to. If all documentation is proper, it should take around 3-4 weeks. Not sure if there is a priority processing in India. You need to check that.

I got struck here with another query.

My baby was born in July 2017,

1)I have read that babies born in UK to tier 2 visa holders is entitled for free NHS only for 3 months(there is also some new law from august 2017, that shouldn't affect my baby who is born on July 2017) Is this true??

If true,
2)we will be using NHS for one more extra month for her 4th month vaccination to be done and then ll start to India, will this cause any problems when we apply visa from India. Is there a chance they could reject visa saying we have used NHS extra time.

I hardly believe HO is going to send out the search party to deport a baby because they had mandatory vaccinations in month 4. Wellbeing of child will ALWAYS come first.

Hi all,
I have few clarification before applying child visa, I am applying child visa for child born in UK from India.

1) Do we need original bank documents or scanned copy of stamped bank documents are enough?? 3 months bank documents are fine correct?

2) My owner has send NOC which states it can accommodate baby sufficiently in 1 BHK, will that be a problem? 1 BHK n baby? Do we need 2bhk if we have baby??

1. Not sure if scanned is accepted. You need to prove maintenance funds for 90 days.

For kids below 11 years(our kids are 4 and 9) , there is no x-ray during TB test. They will ask few questions about kid's health and then issue the certificate. There is TB testing guidance available on gov.uk website if you need specific guidance about infants.

I heard we don't need any Tb certificate since she is born in UK and will be in India for just 4 months..

Hi there,

I'm in a similar situation to yours. And need to ask if my 8 months old baby who outside UK from 1 month, requires a TB test.
HO website does say that minor under 11yrs do not require a TB test.
If you're outside UK for less than 6 months, you do not require TB test.
But, it also say that you need to take your kid to a specialist. Which makes me confuse.
