Citizenship application - 6 weeks per annum absence

Post by printempo2018 » Tue Jan 09, 2018 10:43 pm

Hi fellow immigrants,

do we have here any IT company employees who were refused naturalization on a basis of too much travel?
Previously, all employees of our company who provided detailed letters that they had to go on business trips, had their applications accepted. As of December last year, a number of my colleagues received rejections.

The rules on the application form state that if an applicant had more than 6 weeks per annum of travel, they have to explain the reason. There is no written rule anywhere that business trips must be excluded from reckonable residence (only periods on stamp 2, refugee status periods and some other cases are clearly stated)

Any insights/comments on this forum? Anyone knows anyone in the citizenship department?

if the citizenship provide information about every single possibility in every case the explanatory leaflet would be 200 pages long and that would overly complicate the application hence they provide examples of most reoccurring cases.
If something is not explain that doesn't mean its invalid or non consequential.
they have phone and email services for assistance

its clear on the app form explanation for over six weeks absence and if your unsure if its applies to you or not simply get your company to give you a letter on headed paper to explain one of your work requirement is to travel and send that letter with your application or if you have already sent your application send the letter via register post quote your application reference number.

how about hiring a solicitor , would they be able to secure these type of cases when international travel is part of their role. would be interesting to see if these type of cases are challenged in court and the outcome would be .

Yes, experts are saying that this should be challenge in the High Court. The applicants were never told about this change of rules. The employees will definitely get affected, if travelling is required by their role. Please read the below news that I posted a few days ago (Irish Times). I think that legal advice must be sought in this case, because INIS have deliberately kept the applicants in the dark in an attempt to collect the statutory fee of 175 euros from them most probably.
