This is almost identical to the case I am helping with just now.
I called EEA applications helpline 2 hours ago (0300 123 2253) - and they told me that in this case - you will not get permanent residence.
You needed Compulsory Health insurance as your husband cannot be your sponsor.
I do realise it is silly - but if you would be married to EU citizen - it would be ok - as you would be a partner of a person exercising treaty rights.
Unfortunatelly in this case - you would have to apply on your own and there:
The main categories of EEA citizen who qualify for a right of residence are:
Workers
Self-employed people
Self-sufficient people with Comprehensive Sickness Insurance
Students with Comprehensive Sickness Insurance
As you can see, two of these categories require the EU citizen to hold Comprehensive Sickness Insurance.
I am still awaiting for confirmation if what I understand is correct as my case is just a little bit different - it is a EU wife married to naturalised EU husband (and according to immigration law - I've been told it is the same case as yours - she needs this insurance as well.)
