New COS with same employer for a new job in same SOC code

Hi All

I changed my job with my current employer back in April 2017
I had valid Tier 2 visa till Nov 2018
The new job was in same SOC code but higher pay

Should my employer have taken out a new SOC? they did not take it out at that time. Can it be taken out now?

I am now making my application for ILR when I realised that this is something they should have done
