Salary requirements for ILR from tier 2 general

Post by Yashicadhir » Sat Nov 11, 2017 4:54 pm

Hello, I want to apply for UK ILR in March 2019. I am on tier 2 general visa and my current salary is under 36k, and I want to discuss with my boss about this.

Is that ok that I get the 36k just before my application or shall I have the 35k salary for a period of time (such as a last 1 year) before I submit my ILR application?

Experts Please advise

Many thanks

Any significant increase in salary to meet the £35,000 p.a shortly before applying for ILR will come under considerable scrutiny and will risk the application being refused.

What is the earnings shortfall at present? Note that from 6 April 2018, the minimum requirement will be £35,500.

HI Cassa

Thank you for your reply, at the moment i am on 27k and my requirements in march 2019 for ILR is £35,500.00

So basically if my company agrees to raise my Salary to the required salary for ILR that would help me in my case, right?
But, if they do not agree to raise now and increase 6 months before as its a quite significant raise, will this help or not?

please advise

Many thanks

Hi Cassa

One more query

My Tier 2 General visa stay is 5 days Less than in total 5 Years, whereas requirement is for 5 year at least. while looking around and on the UKBA guidance i found we are eligible to apply 28 days prior completing 5 years.
I also read some other cases on Immigration boards and found only one response was we will be OK to apply ( i also have dependents(Wife) )

So in my case would it be alright or an Extension is needed for shortfall of 5 days in completing 5 years ?

Many thanks

You must have a valid visa when applying for ILR. It does not state the visa must be valid right up to the 5 year mark.

HI CR001

Thank you for your reply, one last question

At the moment i am on 27k and my requirements in march 2019 for ILR is £35,500.00

My Pay rise is due in March 2018 and if my company agrees to raise my Salary to the required salary for ILR (35,500.00) in February 2018 would that help me in my ILR as i will be having appropriate salary during last 1 year prior to my Application for ILR?

In case, if they do not raise now and raise 6 months before my application in March 2019, will this help or not?

please advise

Many thanks

That would be quite a steep hike. What hike did you get in this company previously?
My advice is based on personal research/experience, so pls check relevant UKVI sources.

Hi Mate,

My situation is similar to yours, I don't meet the 35,500 requirement.

Also, how is it looking for you. Will your company bump you up to the requirement salary this year?

Thanks

Hello,

I just wanted to find out with regards to 35k salary, does it mean gross salary or after tax deduction?
My basic salary is 33k and I got bonus for 3k does that meet the requirement?

Thank you
