Sick leave on tier 2 and taking treatment from home country

Post by skengineer » Mon Feb 19, 2018 10:31 am

Hi All,

I have severe back pain since last 3 weeks and have been sick from work since one week after getting my GP letter. I have been taking treatment from local physician since last one week and it is not working for me at all. I am planning to go to India for 4 weeks and get treatment over there as that will be cheaper and effective treatment for me. My question is can I take 4 to 6 week of sick leave from work on being tier 2 visa and go to India for 4 to 5 weeks? I am on my forth year on Tier 2 visa and almost 17 months away to be eligible for ILR. As I have been already sick since last one week and taking 4 to 5 weeks more sick leaves can affect my ILR application? Can anybody please explain me how many continuous days of sick leave are allowed on Tier 2 visa?
What are the other options as I can take unpaid leave as well if needed to. What will be the best option for me to and without affecting my ILR application.

Thank you all readers and who replied to my question in advance

The applicant has not been absent from the UK for more than 180 days during any 12 month period in the continuous period. All absences from the UK during the relevant qualifying period must have been for a purpose that is consistent with the applicant’s basis of stay here, including paid annual leave, or for serious or compelling reasons. If you will be able to prove that the treatment could be only obtained in another country, it should not be a problem for your Tier 2 or ILR. I am not shure that Home Office will acept the claim that "it was cheaper to have a treatment in other country" as a serious grounds to waive the requirement for continuous residence in the UK.
