Apply for ILR after UK ancestry expires

My partner is on a UK ancestry visa valid from 13/3/13 to 13/3/18. He entered the UK on 21/5/13. The concern is that he will have been in the UK for 5 yrs this May 2018 (which is past his UK ancestry visa expiry). Is it possible for him to apply early without having to spend £ to renew his ancestry for those extra 2 months and week?

Indefinite leave to remain: calculating continuous period in UK wrote:Period between the issue of entry clearance and entering the UK

Any absences between the date of issue and entry to the UK are considered an allowable absence. This period will count towards the 180 days allowable absence in the relevant 12 month period. Therefore, it's possible to apply for ILR up to 28 days prior to the expiry of leave.

Hello- I am trying to sort out my dates for ILR application.
My UK Entry Clearance was valid from 29 May 2013 (Date of Entry= 4 June 2013), and thus 5 yrs is 29 May 2018. I understand I can apply as early as 1st May 2018 (28 days earlier than my 5 year mark).
I'm looking at booking my Premium appointment as early as possible (45 days in advance) and this would be 19th March 2018. The gov website says I would need to book the Premium appt as part of my online application. So could I submit my full application already as early as 19th March? (Will I have to prepare all my documents by then despite the remaining 45 days of potential travel outside of UK?)

My understanding is, your 5 years will count from the date of entry into the UK (4 June 2013), You can book 42-45 days in advance for a PSC appointment, BUT, it still must fall within the 28 days qualifying period of the 5 year mark first counted from the date of entry into the UK and NOT when your visa was granted (EC).

hey! its something new i just heard!! i thought 5 years will count from the date i granted my tier2 visa . Like i came with PSW visa in february 2013 but after that i got the job and apply for T2 and then granted the visa on August 2013 . As in my BRP card visa start date was Aug 2013...so my 5 years will be on Aug2018 or Feb 2018 to apply for ILR in 5 years route with sponsor???

I think it depends on which visa you are on, for example, from my understanding and please correct me those on a similar category of you can take into account the date of issue of their visa towards the qualifying period for ILR as per this document Indefinite leave to remain: calculating continuous period in UK on page 8 I think. At the same time I will state exercise caution in what I have stated until confirmed it is the case, this is my understanding, please note this document does not refer to to those on LR or the FM route (spouse visa, family life) and I assumed the OP was on one those routes hence why I believe my understanding is there time starts from the date of entry onto the UK.

If the OP would be kind enough to state what category they are basing there potential application for ILR on?

I should also mention that document above also states what categories are applicable for the conditions set within it.

You have other topics where you state Ancestry.

If you have a partner on a different visa category posting under your username, kindly ask them to register their own username to ask about a completely different visa route to avoid confusion as members do look back at previous posts and topics are merged, as this one has been.

Ok so I think it is understood and confirmed then that I can submit my online application as early as 19th March so that I can book my Premium appointment 45 days later around 1st May (which is 28 days before the 5th yr anniversary of when my Tier 2 General Visa was on 29th May). Phew
