ILR salary requirements

Hi, Hope everyone is doing ok. I will be eligible to apply for my Ilr in next August 2018. My annual appraisal and salary increment was in September 2017 and I will get a salary increment again this year between-July-September which will fulfill the salary requirements for ILR . Actually, 10% increment is good enough for my eligibility for applying IlR.

My question is ..as my 5 years will complete end of July and I will apply after that. SO increment of annual salary 10% this year July/August. will it be any issue or suspicious? Cause its just before the application but its annual increments like last year is increased in this period. Or shall I tell my employer to increase 10% salary in April-May so that i have 3 months before applying ILR.

I am really confused about the matter. Please kindly suggest me

If its a geniune annual increment then I wouldn't worry. Get a letter from your employer confirming recent increment was result of your performance etc. May be take some docs to prove like your annual performance report

But its quite possible home office see this as way to get ILR and hold your application for further checks. This would result HO visting your employer and making sure you were not the only one got the increment !!

Its not case of getting in 3 months prior to ILR. CW can easily see your salary increment pattern from HMRC records. They have software to do tihs all now a days.

Hi,
In the UKVI website, I can see the last update of PBS codes of practice: skilled workers (from 6 April 2015) .
My SOC code is 2473 and there written
Salary rates:
New entrant: £22,800
/ Experienced: £28,300

I got my extension and my salary increased last year as well which is now above £32K. So now I will apply for ILR this year and on the PBS codes of practice: skilled workers (from 6 April 2015) doc I can't see anything written about salary requirement for ILR. I heard it should be minimum 35,500 from 2018. is it right? or different SOC code has different salary requirements for ILR!!?

if anybody can help with the link that would be helpful.

You need to earn a MINIMUM of £35,500pa OR the relevant rate per SOC, whichever is HIGHER.

If you earn less than £35,500pa but it meets the SOC, your ILR will be refused as SOC is LOWER than the ILR rule requirements.

It is pointless reading the PBS Codes of Practice for ILR related salary issues. You need to read the PBS ILR rules, where the salary requirement is clearly stated.

Useful to actually look at the form Set(O) and Tier 2 Policy Guidance :idea:

And the Tier 2 Policy Guidance

Page 63, point 271 (click)

Immigration Rules Part 6 - 245HF(d)(vi) (click)
(d) The pay in (c)(ii)(2) or (3) above must:
(i) be basic pay (excluding overtime);
(ii) only include allowances where they are part of the guaranteed salary package and would be paid to a local settled worker in similar circumstances;
(iii) not include other allowances and benefits, such as bonus or incentive pay, employer pension contributions, travel and subsistence (including travel to and from the applicant’s home country);
(iv) not include the value of any shares the applicant has received as an employee-owner in exchange for some of his UK employment rights;
(v) be at least equal to the appropriate rate for the job as stated in the Codes of Practice in Appendix J; and
(vi) be at least:
(1) £35,000 if the date of application is on or after 6 April 2016,
(2) £35,500 if the date of application is on or after 6 April 2018,
(3) £35,800 if the date of application is on or after 6 April 2019,
(4) £36,200 if the date of application is on or after 6 April 2020,
(5) £36,900 if the date of application is on or after 6 April 2021,
(6) £37,900 if the date of application is on or after 6 April 2022,

Yes. Any sudden large increases shortly before applying for ILR will be a red flag to HO and possibly trigger an investigation of you/sponsor/genuine vacancy etc.

Ya that's true! Thanks . for Ex: my salary increasing in September every year from 2016...and it increased last year as well. My ILR is due on August2018 but i would like to apply on October208 after salary increased this year september.Luckily if it incread 7-10% then i can meet the salary requirements.

So is that ok to apply in October just after my salary increasing in September ?? Cause its annual increament and happneing in september each year from last three years!
