I hope so,but hard to believe ,i have lost my hopes and if i don't succeed in court don't know what will happen next! Am i gonna have right to stay and reapply when the divorce is finished for ROR !? Or do i have to leave the country !? If someone have been to court ,what was their experiences!

Hi, I did go to the court on Friday,it was no one from Home Office ,the judge asked only me not my partner just to confirm the name ,she asked about 10-15 questions and in the end said i will send the results after 3 weeks!
Did someone experienced same situation ,when the HO was not there,could they ask for another hearing or something else!

You need ur ex's ID, divorce certificate, evidence that your ex was exercising treaty as at time of divorce. You need to have been married for 3 yrs and lived in the UK for 1 yr within the 3 yrs, evidence that you are exercising treaty in your own right from time decree was made absolute.
I submitted bank statements for myself and ex for proof of living together, payslips for myself and ex for proof or treaty right and passport for identity. Did not need to submit ex's ID at the time I applied but I understand that it is now mandatory.

Hello Everyone ,

HO is refusing applications for PR even if you have retaing right of residency after divorce and the reason is people are not providing their EX Wives ID/Passport
how can this be lawful ? i just want people in same boat to get together and try and take it to high court through anyone who was refused PR under this reason , we can do fund for solicitor !

There is already a thread on this topic. This rule has been in existence since the 01-02-2017.

The are many refusals on this matter but judges are very positive so far. The appeals have been returning successful, so there is home if you received a reply on that basis.

HI i am non eea national my permanent refused by upper tribunal with no rights of appeal again under s13(8)(c) court and enforcement act 2007.

basically i have lived here in uk with my father since 2011 july on residence card for five years which expire on 2016 oct since that i have appplied for pr application twice and both has been refused and then appeal in first tier tribunal and we had hearing but judge refused due to he thinks i am not dependent on my father because i am earning same amount of money thats why i am not consider as dependent on my father i have lived with my father all these five years hes been paying all the bills and food shopping. I need advice what shall i do next re apply the application because i am not working now fully dependent on my father from last couple of month does anyone can help me with this please.

Hi all,yesterday i found out that my Appeal was dismissed from the court,and the worst thing is that they did send the determination to my previous solicitor ,on 29th of March ,its like i am out of time to make an Appeal against them ,but i looked the dates and there were 2 bank holidays ,so today might be the last day!
Dont know what is going to happen ,my right to work will expire end of month i am doing divorce as well but its taking time . If i could make an appeal than when the divorce come thru i could apply for ROR !!

Please help someone if possible ,anything will help, many thanks.

I think we are in the same way of refusing,
My application for non EEA permanent residence refused for Not dependent on my brother. I went to first Tribunal and the judge refused because she don’t believe I’m dependent on my brother she said you are earning £800 a month which is enough to live a month for one person.
I appealed again to upper Tribunal and I’m waiting now.

Can you please tell me what you done after upper Tribunal.

Also if the upper Tribunal refuse again can I apply for residence card and wait another 5 years.
