Applying for ILR

Post by brunold85 » Sun Jan 21, 2018 6:55 pm

Hi,
I will be grateful if you could write in the replies below rather than re-directing me to some links as I have gone through them already.

I qualify for ILR in Sept.

I just need advice for my wife. My wife came here in 2016 as a PBS dependant. She is a dentist. She cleared her ORE-1 and is now appearing for ORE-2 which I am sure she will clear.

I want her to practise as a dentist after that but current PBS doesn't allow dentist training. I want to make the process as easy as possible for her in order to qualify for ILR after 5 years.

I guess she can get sponsorship from her employer and practice as a dentist once she is registered with the GDC but if not then can she be my ILR dependent and practise?
Is there any category such as ILR dependent that allows practising dentistry.

Is there anyone who can advise me?

Thanks a lot!

Are you applying for your ILR under the 5 year route, or under 10 year long residence :?:

under the 5 year route. I am thinking of the same for my wife's application but once I get ILR I am wondering what is the best option available for her as she is a dentist and would have cleared all her exams in order to practice here. Currently she is PBS dependent on my tier-2 visa.

She can switch to FLR(M) spouse visa once you get ILR, this will however reset her clock to zero and a new 5 year residence period (2 x 2.5 year visas) before she can apply for ILR. The time spent on PBS Dependent cannot be used to make up 5 years and will be lost.

FLR(M) will allow her to work unrestricted.

Hi,
I have a question:

My tier 2 visa was granted on 30/10/2013. Does it mean, I can send my application on 02/10/2018? Have I correctly counted the 28 days prior period?

Can I apply for FLR(M) visa for my wife at the same time when I make this application or do I ave to wait till I get response on my application?
Our visas finish on 14/01/2019

Thanks for the help,
Bruno

Thanks for the prompt response. You can clear my doubt: Since I am eligible to apply on 02/10/2018, it is fine. But because tier 2 visa rules state application can only be made 3 months in advance which means 14/10/2018 for spouse visa. Do I need to send in her application then because her visa finishes on 14/01/2019?
I guess I only have to give the life in the UK test at this time for ILR. Am I right in assuming this?

Thanks a lot for your help.

How is this relevant to dependent visas or switching to a completely different visa category as a dependent??

Your spouse can apply to switch to FLR(M) at ANY point before the current visa expires.

Its because I don't have ILR yet. Hence I thought I can make in an application on 02/10/2018 but wasn't sure if she could apply the same time as me for her FLR(M) because we both will be applying by the postal route.
Because she will be switching from her current tier-2 to FLR(M), I wasnt sure if application before 3 months could be considered.
Thanks!

The 3 months is irrelevant to dependents.

You should consider applying for ILR in person for a same day decision. Then apply by post for FLR(M) if you don't want to apply in person to save money.

Postal applications can take 8 weeks up to 1 year.

ILR dependent

Post by brunold85 » Mon Nov 26, 2018 3:31 pm

Hi,
I am settled in the UK and got my ILR based recently based on tier-2 visa (5y route, 2013-2018). My wife was dependent with me from Apr 2016. Now we have applied for FLRM visa. Will she be able to apply for ILR based on 5 years in total or she has to complete 5 years in one category.
Thanks,
Bruno

Why did you changer her visa route??

Shr should have applied for tier 2 dependent extension.

She cannot apply for ILR combining pbs dependent and flr m visa to make 5 years.

Topics merged!!! Useful to continue in an existing topic so that members have the full details and circumstances.

The advice you have previously bee given remains the same. Flr M resets her clock to zero and a new 5 year route to ILR.

She has no restrictions to practice as a dentist if she gets FLRM. She is currently sitting her second exam to qualify and practice here in the UK. Previous visa had: no dentist/dr training remarks.

Yes, I realised this after reading and merging your previous question posts which is why I said useful to continue in an existing topic so that members have the full circumstances of your question.

The answer doesn't change. She needs 5 years on FLR M before she will qualify for ILR. The time spent on pbs dependent is irrelevant now.
