Anyone, regardless of visa category, cannot skip ILR and apply for BC directly. BC requires the applicant to be 'free from immigration time restrictions', ILR. Once she has ILR and you are BC, then yes, she can apply immediately as spouse of BC provided she meets ALL the requirements.

There is no 'dependent of BC' category for citizenship.

Hi,

Could some one let me know how early can I apply for pbs dependent visa extension for my wife. Her visa expires in 25th September 17.
And how do we decide the minimum term we need to extend for . As my wife needs visa till Jan 2018, to be eligible for ILR.

I rememeber extensions could be done 3 months from date of expiry and I don't know if that's still the same,

You can apply at any point. She can only apply for a 3 year extension, you cann choose the length of visa you want.

Hi CR001,

I am not sure what you meant about applying any time. Do you mean that I can apply rite now for an extension? How does that work out, if usually you are not allowed to apply more than 3 months in advance. Her current visa expires on 25th Sep 2017. And End of Jan 2018 she will eligible for ILR.

Please do suggest the correct method and length of visa. I don't want to be paying for a 3y NHS if I don't have to. And I read we can get the NHS fees back if we apply for ILR within 1y of current extension.

Please do clarify

She cannot apply for less than a 3 year extension. That is written in the rules and is what she will get, you cannot choose the length of extension you want. You have to pay 3 years health surcharge otherwise she cannot apply.

Unless you provide the link you read somewhere re getting surcharge back, I can't comment.

So there is no time frame within which she has to apply for extension?

Because if thats the case we would just do it now and get it done and if we get the visa soon, may e apply for ILR at the same time.

I read it somewhere on the forum regarding NHS refund if applied for ILR within the year of paying for NHS fees and also remember being told the same from UKBA customer care

Hi,

I am a bit confused about whether I can apply for the extension just now, as I am getting mixed information about, not being able to apply for extension, if you have 3 months or more of valid visa.

The PBS dependent visa is Ending in 25 Sep 2017. Which is still 3 month and a bit away. So can we still apply for extension, while the current visa is not due to expire.

Bearing in mind the new visa is a PBS dependent visa Extension.

I cant find any such rule mentioned on the UKBA website.

We have done the online application, but before paying for NHS, I wanted to be sure that, it isn't too early to apple for extension.

PBS partners may apply for extensions at any time prior to expiry of leave. They will grant period of leave in line with 319D(a).

Hi,

My wife has had her ILR and I was wondering is there a way we can secure refund on nhs fees which we paid for last extension. Which was granted for 3y and we had to pay 600 pounds. But she only needed to do 3 months to be eligible for ILR. Now since have been granted ILR. Could we get the refund for nhs fees?
