Tier 1 Ent. 50K route ILR Query

Hi All

I have got my Tier 1 ent extension 50K and i am applying for ILR based on 5 years route next years end of Feb 2019.

I am still confused that do I have to apply for my child's extension with my ILR application cz he born Oct 2014 and has not completed 5 years as my dependent on PBS or shall i leave it cz he has already got 2 years ext with me in March 2018 that will last till march 2020, and apply his ILR directly after one year when my ILR approved ?

Please advise..

Children are not subject to the minimum 5 year residence. Child can apply for ILR with you.

If the child is UK born and you plan on registering the child as British, the child DOES NOT require ILR.

There is no 5 year requirement for your child.
As long as both parents qualify for ILR, the child does too.
So, you can choose to apply for his ILR with yours or at a later date - your choice.
Also, if he was born in the UK, you have the additional choice of applying for a british citizenship once your ILR is approved and avoiding the ILR phase totally (if you don't want him to retain the home country citizenship)

Yes my Child was born in UK Oct 2014 and i have got his both initial dependent visa and this two years recent extension as well with me in March 2018. So it means i don't need to send his application with me and my wife's ILR based on 5 years route next year in Feb 2019 and once we got our ILR then i can directly apply for his British Citizenship ?
