IHS Payment

Post by KenBossini » Wed Mar 28, 2018 1:36 pm

Hi all,

I had Tier 2 (General) visa and got ILR last year on the basis of 5 years residence. I will be extending my wife's PBS dependent visa later this year. Please see our immigration summary below:

Me:
First Tier 2 visa validity: 20/08/2012 - 19/09/2015
First entry in the UK: 21/08/2012
Tier 2 visa renewal: 21/07/2015
Second Tier 2 visa validity: 21/07/2015 - 03/08/2018
ILR received: 21/08/2017

Wife:
PBS dependant visa validity: 07/07/2016 - 03/08/2018
First entry in the UK: 20/07/2016

From reading a few posts on this forum, I gathered that I can pay IHS before starting the application and it is easier to just use this IHS payment reference number during the application. When I attempt to pay the IHS, the website asks for expiry date of sponsor's (my) visa to calculate how much IHS my wife would have to pay. As my ILR BRP expires on 31 Dec 2024, I put in this date. The system calculates IHS as £1400, which I pretty sure is not the right amount. What date should I be entering as the expiry of my visa to get the system to calculate the correct IHS amount?

Thanks,
K.

You are an ILR holder now. I would think your wife would need to apply for a Family visa. Read further here https://www.gov.uk/uk-family-visa/partner-spouse

If you are not sure, rather don't give incorrect advice.

The OPs dependents DO NOT have to switch to settlement visas. They can continue to extend the current PBS dependents visa until they qualify for ILR, the immigration rules permit this.

Thank you for your responses. Yes, I am sure I will need to extend my wife's PBS dependent visa.

Can someone please advise how do I get the system to calculate the correct IHS?

If I do not click on the 'Add this person's details under the 'Are you applying to join and remain with a person already in the UK?' section, and simply continue with her application, the system calculates IHS as £600, which I believe is the correct amount. However, is that the right thing to do?

Thanks,
K.

Documents required for PBS Dependent extension

Post by KenBossini » Thu Jul 12, 2018 12:02 am

Hi,

I had Tier 2 (General) visa and got ILR last year on the basis of 5 years residence. I will be extending my wife's PBS dependent visa later this month.

We will be submitting the following documents:

a. My passport and her passport (original)
b. My BRP and her BRP (original)
c. Our marriage certificate (original, in English)
d. Her bank statements proving that she has at least £630 in her account for last 90 days (original)
e. My bank statements proving that I have at least £945 in my account for last 90 days (original)
f. Proof of cohabitation - At least 12 documents (6 for each of us) from at least 3 different sources spread over last 2 years
g. Her passport-size photographs

Do we need to submit any more documents?

Thanks,
K.

You don't need "e". You are not required to show maintenance funds for yourself as you hold ILR, you only need fu ds for spouse.

Thanks CR001.

i. Hypothetically, if my wife is a home maker and does not have a bank account, will we be relying on my bank account statements to evidence enough maintenance funds for her application?

ii. Can we use latest bank statements for evidence of both - maintenance funds and cohabitation?

Regards,
K.

Your post is not clear. If you and your wife are applying for ILR, there is NO maintenance fund requirement for EITHER of you.

Hi CR001,

I already have ILR. We are applying for my wife's PBS dependent extension (not for my wife's ILR). If my wife does not have a bank account or not sufficient maintenance funds in her account, can we rely on my bank account statements for evidence of sufficient maintenance funds ?

Also can we use bank statements for evidence of sufficient maintenance funds as well as evidence of cohabitation?

Thanks,
K.
