ILR Validity

Hello,

I'd enter in UK with entry clearance on work permit in Jan 2004 for 6 month till 26th June 2004 then went back. Again came to UK on new work permit with entry clearance for the same company in 22nd August 2004 till then I am here continue with change of employement and further to leave extension. Therefore, what is the validity of my qualification for ILR? Would it be counted from first entry Jan 2004 or second entry August 2004. When I would be eligible to apply for ILR?

Because of the gap you had from June 04 to Auust 04.

The clock would start ticking from the time you arrived on the 22nd August 04 so you will be able to apply for ILR in August 2010.

Ok But the gap is less than 6 month as per what it said in guideline. Even If I consider this gap which is less than 6 month, I can apply in August 2009 (Completing 5 yrs) NOT to wait till August 2010( 6 YRS).

Could you please advise?

You didn't have any UK status those 2 months, so your clock is reset. If you just went on holiday for 2 months while on work permit, it would be different.

My mistake you can apply in August 2009 not 2010.
