Tier 1 Dependent continues stay query

Hello Guys,

I would be thankful if someone can shed some light on my query. My wife joined me as dependent in 2011 while I am on PSW and got extension as dependent when I moved to tier 1 Entrepreneur visa back in 2013. Later in 2016 when I applied my extension she went to India and got entry clearance dependent visa. There is about 7 months gap before she got her dependent visa from India. I am applying for my ILR (5yr route) in July 2018, can my wife apply ILR with me ?? Any information on this would be helpful for me.

What date did she leave the UK?

What date did her visa expire while she was out of the UK?

What date was her new entry clearance visa applied for and then what is issue date?

What date did she leave the UK?

She left UK to India on 18 May 2016.

What date did her visa expire while she was out of the UK?

Her visa expired on 20th June 2016 and she is in India when it expired

What date was her new entry clearance visa applied for and then what is issue date?

She applied for her Entry clearance on 20th Dec 2016 and approved in first week of Jan 2017 and she entered UK on 20th Jan 2017.

Her clock has reset to zero and she will have to wait 5 years on her current visa path before she will qualify for ILR.

The time prior to her leaving the UK is now lost.

Thanks for the update , what category does she need to apply if she is applying with me at same time and could you please update me with below question as well. Sorry for asking too many questions

My Son was born in India in Aug 2015 and got his Entry clearance in Nov 2015 and came to UK in Nov 2015 and got valid visa as my dependent till 20 June 2016. he left to India as well with my wife in May 2016 and got his entry clearance along with my wife in Jan 2017 and got visa till December 2018 now. Is he eligible for ILR or does he need to wait 5yrs same as my wife?

I got my visa till Dec 2018 but I am qualified for ILR (5 yr route ) in June 2018 as I got my first T1 Entrp in June 2013.

Tier 1 dependent.
