Post by hashim2018 » Mon Jan 08, 2018 5:11 pm

Hi,
I have Tier 2 General visa and my husband is on PBS dependent visa which is valid till Dec 2018. I am eligible to apply for ILR now. But My husband do not fulfill the condition of a partner for 5 years. I want to know if i am applying for ILR now, do my husband need to apply as a dependent again. Do he need to switch visa as he would still be on dependent visa.
If Yes then Do he need to apply with me, or can he apply later.
Please guide.

Thanks

He can extend his PBS Dependent visa shortly before it expires. No need to switch visa category if you are applying for ILR based on Tier 2.

Post by hashim2018 » Tue Apr 24, 2018 8:55 am

HI, My husband is currently on spouse visa, valid till 06 dec 2018. His 10 years stay in UK will complete on 19 jan 2019. Can you please guide Can he directly apply for ILR on or before 06 dec 2018, as there is around few weeks gap for becoming eligible for ILR or do he need to apply fro extension first.
Thanks

He will need to apply for an extension first. If he applies by post, then when he meets the 10 year ILR requirement counted from the original date of entry to the UK, then he can vary his dependent extension to ILR.
