ILR due in Feb , Child born in UK but currently in India , what visa i should apply

Post by ImranS » Mon Dec 18, 2017 12:22 pm

Hi All,

I need your advise as i am not clear what steps i need to do:

I am due for an ILR in FEB 18. My daughter was born in UK (Sept 17) but had to travel to india due to some urgent work with my wife. They left in Nov. I had applied for an indian passport without UK visa for my daughter. I am planning to apply for BC(British Citizenship) once i get my ILR. I thought it would be an easy process but it isn't.

Question:

1. Can i apply for BC for daughter from India once i get my ILR? How long will it take? Is it a lengthy process? What is the process?
Or
2. Can i get her a visit visa and then apply for BC once she is here?
Or
3. Should i apply for ILR and then BC once she is here?

My wife has visa till May 2017 so i will apply for ILR dependent visa once she is here. Here ILR is due in 2 years time.

Are here any other options? Appreciate your advise on this.

Technically yes. Decisions can take months, even applying within the UK.
2. Can i get her a visit visa and then apply for BC once she is here?
She isn't a genuine visitor is she??
3. Should i apply for ILR and then BC once she is here?
She doesn't need ILR. You could apply for a Tier 2 dependent visa for her to return to the UK and then register her as British once here.
My wife has visa till May 2017 so i will apply for ILR dependent visa once she is here. Here ILR is due in 2 years time.
Your wife should return before her visa expires so that she is able to apply to extend her PBS Dependent visa. There is no requirement to switch to ILR dependent visa if you apply for ILR based on 5 years residence.

@ImranS
How did you apply BC for child?
If it is from India directly or after getting child on visitor visa how did it go?
We are in same situation, so looking for best option to get BC!!
