PBS Dependant....urgent Help needed

Hi,

I finally got my ILR yesterday after 5 years tier 2 visa and thanks to this forum.

My wife has only been on Tier 2 for two and half years and her visa expires in a month i have been told she needs to extend it under PBS dependant.

I have asked lots of friends and no one came across this situation, could someone please help me as visa expiring on june 14th 2018.

What are the required documents for the PBS ?

is a letter from the Sponsor would be enough for Funds maintenance ?

Do we need to wait until i got my BRP to attach with application ?

Oh No!! we are in huge trouble now then, because i thought a letter from the Sponsor would be sufficient hence wasn't maintaining any funds and her visa expires in a month's time.

we are from India, so we need to show £630 equivalent in Rupees ?

I am not familiar with the Indian currency but it must be at least £630 for the full 90 days.

in worst situation, she will go to India, can i maintain £630 in my UK bank account and send the statements to india after 90days so that she can apply in india ?

No, she won't be able to apply for a PBS Dependent visa from outside the UK as you now hold ILR. Extending her current visa is only possible within the UK if you meet all the requirements.

Her only option now within the UK will be to switch to FLR(M) and a new 5 year route (2 x 2.5 year visas) to ILR.

Can the funds be from one of her family members in India ? like mother or brother ?

sorry for all the questions, bit panicked now as we have a baby i was hoping to apply visa for wife and apply passport for baby but if i can't extend visa for my wife i think both needs to go to india.

I don't think so. I understand it must be in either of your accounts. You would need to read through the PBS Dependent guidance notes but my understanding is that 3rd party funds can't be used.

PBS Dependent guidance notes doesn't mentioned it anywhere about third party funds, also it does not mention "Maintenance requirements for Family member of ILR"....it mentions all the other

"Maintenance requirements for Family member of Tier 1"
"Maintenance requirements for Family member of Tier 2" etc..

For an exentsion of her current visa, she would apply for a PBS Dependent visa and NOT an ILR dependent visa.

You can apply in person within the UK, but you won't get the visa if you have not maintained funds for 90 days.

Went to meet a solicitor over the weekend he said below, don't know if it's correct.

1. there were cases where Tier 2 Sponsor letter accepted by the case worker.

2. join the dependant to anyone's account who has funds £630 from last 90 consecutive days and take a letter from the bank and consent letter from the other account holder.

Could you someone please let me know if can be done ?

Usually only if you are still a Tier 2 General main visa holder. You are no longer a sponsored migrant and are free from immigration control.

Not sure if this will work. The rules are fairly clear on source of maintenance funds.

I have started filling the form from the link above and i filled everything and my next thing is payment.

it didn't ask for IHS fee or IHS reference number so far.. did i do something wrong ?

or i just need to pay in a IHS site and take the Form with me ?

Hi CR001,

I have two final question, Really Appropriate if you can answer ASAP.

If she apply for FLR(M) and while decision is still pending..

1. Can we vary the application to file for PBS extension with 90 days funds maintenance ? to carry on in her 5 year route to ILR through PBS Dependant.

2. Will it reset her PBS Dependant to 0 if FLR(M) refused i case ?
