Lots of ILR Questions

Post by TreeHugger7 » Thu May 10, 2018 10:45 pm

I will apply for ILR through Tier 2 route soon, next month hopefully. Few questions related to ILR,

Question no. 1
On form it says following, I came as student then PSW then Tier 2, what evidence can I provide for this ?

For the period before you were granted leave as a Tier 2 migrant, documents showing that you met the relevant requirements of the immigration rules. For further information concerning the evidence required, please refer to the Tier 2 migrant policy guidance on our website

Question no. 2

In form it asks for where I live... I have 2 addresses,

- Permanent Address (This address was owned by me and my relative and both names were on mortgage but a year ago, I removed my name from mortgage and relative says they removed my name from register too ? As I don't understand UK house ownership I am not sure what to look for, however my name is still on council tax for unknown reasons even though I don't pay it) This address is on my payslip, also on previous home office applications and driving license.

- Temporary Address (I am renting this place for 3+ years and rent is clearly going from my bank + council tax), what address should I provide to home office in section Nationality Details where it asks for it ? for example question says
What is the ownership status of your home?

Now I have more then enough bank statement, I don't get why HO wants to know whether i own a house or not and what should I tell them

Question no. 3

I took 1 week paternity leave but in same month I sold 1 week holidays to employer too, do I need show bank statement and payslip from this period and month before and after too ? I will attach P60 for this year anyway... which shows my salary remained above rate required for SOC always

Question no. 4

What is best time to look for PEO appointment, I need one of 20th next month but nothing is coming up for that time, I am trying for a week. Also any trick or tip anyone using as staying awake till 1am is not convenient for me and possibly others too :(

Many Thanks

Do you stay some copies of your BRP/visa?
Actually if you apply through Tier2 route they are not required.

The ownership is not the matter, your bank statement, council tax bill are your address proof.

I can confirm I am not owner of my main address, which is on my driving license as well as it's my relatives house and permanent correspondence for me, however I rent 2nd place, do I have to provide any documentation on this ? Thanks

I took 1 week holidays + paternity holiday for 1 week, this way my monthly salary wasn't disturbed.

No. I don't think so. When I applied I cannot provide all as well.

You don't need to explain why the address on your driving icense is different from your home address

URGENT Re: Lots of ILR Questions

Post by TreeHugger7 » Tue May 15, 2018 9:15 pm

Thank you.

I have a urgent query about this. I came across this, just now,

Image

I was in UK and I applied Tier 2 when I was on PSW, does that means I can apply 28 days before date of application as well ?

Date of Application : 15/05/2013
Date of Tier 2 Issued (1st time) : 16/07/2013

Does this means I was able to apply for ILR 28 days before 15/05/2018, Can I apply tomorrow for ILR ? PLEASE Help me urgently.

THANK You Very Much

Date of Tier 2 Issued (1st time) : 16/07/2013
For your circumstances, it starts to count from the date your Tier 2 general visa was granted.

You need 5 years (minus 28 days) to qualify for ILR, in a qualifying visa cateogry (PSW is not a qualifying visa category).

The piece you are quoting clearly says "counting backwards from..."!!!

I don't know if this is going to a problem for your ILR application. However, having an incorrect address on your driving licence can cost you £1000 in fine. Best have it changed:

Thank you for your reply.

I don't have wrong address on driving license. This is what's happening. I have 2 addresses, one is permanent and one is rented...

Permanent Address (it's on my driving license, pay slips, bank statement, HO records have this address for previous application...) However I DON'T own this property or neither rent it. This permanent address is owned by my brother in law and I occasionally live there, I get all my bank statement posted to this address and I receive them and any other letter. I used to co own this property and pay mortgage but that was an year ago... but now I don't have any stack in this house, but i want this to be my permanent address for me and I go and live there now and then.

Temporary Address (I am renting and living in this property for 3 years), I have council tax letter I received within 3 months, can get tenancy verification letter too...

Now I am confused with what should I put in my application form. I want to put my permanent address as that's where I prefer to receive my letters.

Thank you all

Thank you so much zimba.

Can I add this explanation where it asks for if I OWN it or RENT it...

"I live with my sister and brother in law at property X which I don't own or rent and I also rent property Y for which documents are attached with this application (Tenancy confirmation and council tax)"

soooo soooo sooo many thanks.

URGENT :: What is the ownership status of your home?

Post by TreeHugger7 » Sun Jun 03, 2018 12:47 pm

I have 2 address,

First is permanent address on my driving license, bank statement and payslips. Property is owned by one of my relative and they live there as well.

Second address is near my work which I rent... I have council tax on my name and broadband bill and confirmation by landlord.

Now what I put in question below ?

In start of form I put my permanent address which is on my payslip etc..

You need to stop saying that you have two addresses, having access to your relatives' houses doesn't make it yours. Your rented property is where you live and that should be the address on your licence and other documents.
You earlier said that the property was initially owned by you and your relative, but you later removed your name from the mortgage. why? owning a house in the UK does not affect your ILR in any way, so I don't understand why you were scared of being a home-owner.
You have to choose one address as your home address and make sure you have enough document tieing you to the address. Your relative's house (as it were) can be used as a correspondence address but cannot be your permanent address. which address does home office have on your record? which address did you use the last time you applied for a visa? Did you update UKVI with your new address after you rented a place?
I am not a lawyer and do not claim to be one. All my comments here are based on my opinions, experience and interpretation of the appropriate UKVI guidance documents and immigration rules.

the government runs a centralised system where your HMRC record can be linked to your immigration record and drivers' licence etc. As much as possible, your address should be the same for HMRC, UKVI and drivers' licence. It looks like your "permanent address" is on your licence, bank statement, UKVI and payslip and the only thing you have for the rented property is council tax and utility bill.
how many days in a week do you spend at the rented property and how many days at the permanent address?
Are you on voter's register? if yes, where?
Sorry if I am making it sound complex, choose the address that is convenient for you and most represent where you live and most importantly that you have proof of residence.
one of the reasons for asking about ownership is to know how much it costs you to run your house monthly as a function of your income as you will see in further questions. if you use the permanent address, you will not be able to answer the question about the cost of running the house since you are not paying mortgage or rent at the permanent address.
Maybe I'm thinking too much about it.

Many people have 2 addresses. Only difference in my scenario is that I don't own or rent my main residence...

Which is why I am hoping gurus or someone in similar situation would help.

I want to put my permanent address and then add additional address in explanation of other. Also fill in rent for additional property I rent if all HO wants to know how much I spend on accommodation then that should be enough ?

At the end of the day I do live at both address and I consider property I don't own or rent as my main residence.

HO don't care how much you pay in rent. they want to know your address and if it matches your documents.

Simply explain your circumstances or get professional advice if you are not sure.
