I need help please ....
I got my retained right of 05 years residency (biometric card ) on 02/2018.
I came to UK on 06/2013 ,i got married with my ex-wife(polish) on 08/2013 and i got my first 05 years residency as a family member on 01/2015. which is after nearly one year and half of waiting and the appeal .
My ex applied for divorce on 09/2016 after 3 years of marriage and we got the divorce absolute on 02/2017.
From 01/2015 to 12/2015 : i been unemployed for 4months (support my self from my savings).
from 01/2016 until now : i been unemployed for 03 months (support my self from my savings).
I never applied for jobseeker allowance .
I would like to ask you please ,when i should apply for PR residency ?
If the gaps for been unemployed gonna affect my application for PR ?

what are the exact dates when you were unemployed, if you were unemployed before the divorce finalised, it should be alright but to qualify for PR, your spouse should have been employed from marriage till decree absolute, then from decree absolute till the fifth marriage anniversary you should be employed... hope this helps

You ought to have been in.employment from 2017 to now, or have CSI for the period you claim to have sufficient resources.

Hi Cam123 and Obie ,
The exact my unemployed dates are : 01/2015 to 03/2015 (2months) , 08/2015 to 10/2015 ( 2months ).
04/2016 to 07/2016 (3months).
i been supporting my self from my savings ,i didn't apply for Jobseeker allowance that time but i have emails showing that i was looking for job that time .
I got the divorce absolute on 02/2017 after 03 years of marriage .
From 07/2016 i been working continuously until now .
About my EX wife employment : for your information ,we got married on 08/2013 ,so :
from 2012 to 01/2014 : jobseekers allowance (claiming benefits).
from 01/2014 to 12/2015 : was employed .
01/2016 to 06/2016 : Jobseekers allowance (claiming benefits).
06/2016 to 03/2017: was employed .
So can you tell me please if i'm alright to apply for PR ? and when exactly i have to apply for it ?
I need help please ,

You have been unemployed before divorce hence you will be alright, so you don’t need to worry.

Hi obie,
He is working continuously from 07/2016 until now and he got decree absolute on 02/2017...
in order to secure PR, he only needs to demonstrate that his ex was exercising treaty rights from the date of marriage till decree absolute...

To demonstrate that my EX wife was exercising treaty rights from the date of marriage (08/2013) till decree absolute(02/2017) ,i have HMRC letter showing all the employment history of my EX wife as a jobseeker allowance and employee .
do i need to have more proves or that's enough ?
In my case , when i'm eligible to apply for PR ?

Got ror last year December
Got email from home office asking me to attend the interview in Liverpool
I have never seen or can’t find any rule where home office calling non eea pr applicant for interview after ror.

Yes I sent original I.d for my ex I am still in touch with my ex as she is still giving me any documents I need. She got a new partner but she is still willing to give me any document I need.

Hi pola,
I did go for interview it lasted 1.15mints home office lady was a bit rude asked me so many question did only 2 mistakes one was my ex wife miscarriage date and second was I said she got paid in bank 3 months later on cash but interview lady said her payslips say she got paid in bank 7 months then she was getting her salary in cash.
Few rude question she said y ur divorce took 11 months in uk divorce takes only 6weeks I looked at her and asked where is this court where court can give divorce in 6 weeks.
Few other stupid questions asking my wife’s boss name I said I don’t know
Asking my ex work place I told her address asked told her as well.
Asked about my work told her yes I am working.
Asked about witnesses why only my friends were witness in the marriage.
Asked about venue of marriage.
Overall she was not gentle at all but I have done only two mistakes.
She also asked where my ex living now I told her.
She asked what work her company does where she was working explained her about company work.
Then asked what was her job role in that company explained her my ex job role.
Waiting for decision still no reply.

Hello ,
Seems like they tried to stress you and get a silly statement to accuse you for marriage of convinience . they will get no where .if they refuse you . first tier tribunal should be enought for you .
I cannot believe they called you for interview after you have had your residence as ROR ....
Do you have solisitor ?.
