Guys,

Appreciate a quick feedback to the query below ... as I need to post the application today itself ! Thanks in advance.

My wife's initial leave to remain under HSMP is expiring next week and we are sending the Tier 1 application form along with the relevant documentation.

Wanted to know if, like the older days in times of HSMP extension, do we need to include the employment contract and tenancy agreement along with the application ???? The Tier 1 form or the Tier 1 policy guidance doesn't mention anything of the sort but I thought it wise to check with members on this forum.

Like I said, appreciate a quick feedback.

Hi

Employment contract: If u not filling the requirements of p60 or payslips or bank statements

Tenancy agreement: u dont need it anymore

Hi,

Even i am on HSMP and now applying for Tier 1 for FLR..

Can u please tell me :
1)On page 16 of application form ,there is a question which says .
Does the applicant hold an unexpired letter under HSMP,If no then go to section 3a. (this is NO for me since i had HSMP letter which is very old.)..
But under that statement one more question is
If the applicant currently in UK under HSMP, if YES then go to section 3c Now this is true as well since i am on HSMP..
So we have to go to section 3a or 3c??

Ashish,

It will be 3c. Section 3c is specifically for HSMP extensions.
You have an "expired" or "unvalid" letter of approval (remember the 6 month validity rule). So 3a is not for you.

Ok..So basically we can JUMP to section 3c..NO need to fill pages 16 to 27??Am i correct in saying this??

Hi sushdmehta,

final questions :)

1) On page 16 , there is a question (just ABOVE the question which i asked you in last post)which says :
Is applicant making an application for
a)Initial entry(switching) inti Tier 1 (General)
b)Extension within Tier 1 (General)...

When i look at the form fully , i feel like option (B),but if you see i am making an initial entry for Tier 1 as i am on HSMP and not extending Tier 1 as such.( I am extending HSMP into Tier 1 ) which is option (A)..So which option to choose??

2)On last page, you need to write down all point you are claiming...But it also includes Eng. language Req and Maintenance section ..So do i put 10 point agaisnt them as well and then in total ,add all the sections or i shd. add the relevent section(without Eng language and Maintenance)..

It is b). You will understand when you go the next question being asked.

Add all points to arrive at the total (including English and maintenance funds).

HSMP approval in March 2006. Initial leave to remain under HSMP granted in May 2006.

Application sent: 01-May
Application received: 02-May
Payment deducted: 02-May
Reference number: PB304....19X/001 (received 08-May by post)

Documents submitted in the application:
1. Cover letter
2. Tier 1 application form
3. Passport
4. Payslips for 12 months
5. Bank statements showing salary credit of the same 12 months.
6. IELTS test report
7. Bank statement as evidence of maintenance funds.
8. Self-addressed prepaid special delivery envelope.
9. Two photographs

I have referred to the JR judgement in the cover letter but have provided all documents required to qualify for extension under Tier 1 criteria.

Quick question - I wasnt planning on sending my original Degree Certificate as I already did this with the initial application and it has been verified by the Home Office. I have made a note about this on my coverletter.

Am I correct in doing this?

If its for qualification requirement, you do not need to resubmit it if you already have done so for your initial applicaiton.

However, if its for the english language requirement, you will have to.

It should be noted that the only reason I applied for this extension is that I simply ran out of time. I tried numerous times to make an appointment with the Home Office at a PEO after the AIT case and when they heard 4 years they weren't interested.

I have little doubt that I'll be requesting my passport back when they finally start taking appointments for 4 years ILR qualification.

No Im using my passport (National of an English speaking country) for my English language requirement. Although the English language requirement was also proven first time around as well.

Just another hoop to jump through (again).

Guys,
I am also applying for my renewal under Tier 1 this month. I am in the process of collecting the docs and filling the application.

My initial HSMP was granted in Sep 06 but the entry clearance was obtained in Jan 07. Will I get the benefit of the JR ruling ??

from what I understand, since JR is applicable for anyone admitted to the HSMP scheme by Nov 06, I assume I also can benefit from this. Can someone confirm this for me please?

Will keep you'll posted on the status of my application.

Shifi,

The JR judgement should favor you since you have an approval letter dated Sep. 06.

Everyone is eagerly waiting for BIA to publish new guidelines for all those affected (JR) .... let's hope it is done before the general elections in 2010 :D :wink: !

Let’s hope so. You never know how thinks will change with new government (which is eminent now) :D.

But I read in some posts that we can attach a copy of the judgement and mention that I need to be considered as per old ruling. Do you know where I can get a copy of the judgment in printer friendly manner?

Tired of waiting for the reference number even after 6 days of payment deduction, I had sent them an email today morning asking for one.

But found a letter in my mailbox late afternoon from BIA acknowledging receipt of the application and advising the ref. no. This was definitely a surprise as I didn't know they send reference numbers through post these days.
