Tier 1 50K Entp switch to Tier 2 work permit

Post by tier1sun » Mon Jun 18, 2018 3:07 pm

Hi All,

Applied extension on June 2017
May 5, 2018, has interviewed. [No outcome until now]

One of my client willing to sponsor me on Tier 2 work permit for 3 years.

My questions:

* 3 years in T1 Entrepreneur initial and 1 year in extension applied + waiting process = 4 years Completed.
I had an interview on May 5, 2018. No result until now.
If my visa is rejected based on interview/document based, can I switch to Tier 2 visa?
If I switch to tier 2 after tier 1 rejection and granted visa, will it count towards 5 years ILR Route & (eligible to apply ILR on June 2019) ??

* My dependant is here from April 2015. So far 3 years 2 months completed as Tier 1 Dependant.
After next 2 years as Tier 2 dependant, will it count towards 5 years ILR Route & (eligible to apply ILR on April 2020) ??

* If my T1E visa refused based on the interview?
can I apply for Tier 2 before AR/ After AR??

Thanks
Kishore

Yes (unless for example deception was the reason for your refusal)

thanks for your quick reply Zimba.

I explain a scenerio. need you to advise
* If my visa rejected on July 2018 based on interview [no deception] based on Genuity or some useless points.
* Mid July 2018 applying for AR
* AR refused on Aug 2018
* Applying tier 2 - Sept 2018 on postal application
* Tier 2 visa granted on Jan 2019
* Feb 2019 to July 2019 [6 months] on tier 2.
* 5 years completed on July 2019

My Questions are:

1. How many days will be given to applying for a new visa after AR refused?
2. Am I eligible for one day Tier 2 priority service or only postal application can be done?
3. Tier 2 application waiting period from Sept 2018 to Jan 2019 will be counted towards 5 years ILR?
4. July 2019 - will I be eligible for ILR if I have gone through above scenario?
5. Can I revoke my visa now and apply for tier 2 before Tier 1 decision made?

Thanks

My Questions are:

1. How many days will be given to applying for a new visa after AR refused? 14 days
2. Am I eligible for one day Tier 2 priority service or only postal application can be done? You should be able to do PEO if you can get an appointment on short notice
3. Tier 2 application waiting period from Sept 2018 to Jan 2019 will be counted towards 5 years ILR? Yes, provided it is successful
4. July 2019 - will I be eligible for ILR if I have gone through above scenario?Yes, as already confirmed
5. Can I revoke my visa now and apply for tier 2 before Tier 1 decision made? You don't have to withdraw your extension, you can just apply to vary it to Tier 2 - that has the advantage you will remain under Section 3C

Thanks
