Hi,

I have applied for ILR based in Tier 2 General, during my 5 years I stayed with the same employer and got 2 Increments after extension back in May-2016. One in Dec-2016 as it was due from last 1 year and then another in Dec-2017. But my employer did not update it in SMS portal. As now I have already submitted the application, and as per wording in duties
"• A change of salary from the level stated on the CoS, other than changes due to annual increments or bonuses"
mean it's not necessary to notify change and same my employer stressed.
But I a bit worried that should I force him to notify into SMS portal or not?
My salary was already above the limit of 35K at the time of extension and these increments are genuine.
Please guide me.

How much was the increment? Did everyone else in the company got a comparable increment at the same time?

I have no detail for others, as this is not disclosed, but the review was done for some others as well who completed year(here salary review is done individually on the completion of their year with company), and raise was 5K, remember I am already above the 35k before extension so that raise was not to match my salary with ILR requirement.

I was already well above the 35K before Tier 2 extension, so that rais was not to match my salary for ILR, that was genuine annual increment after yearly review. not sure how HO assume annual increments need not to report on SMS portal...

if there are any significant changes in the sponsored migrant’s circumstances, for example:
• A promotion or change in job title, or core duties, other than those which need a change of employment application – the ‘Change of employment’ section has more information on this
• A change of salary from the level stated on the CoS, other than changes due to annual increments or bonuses

As per my employer above rule does not apply to you as you got annual increment.

I don't think it's going to be a problem. I received a £6K raise and wasn't asked any questions. Although, mine wasn't an annual increment and was reported via the SMS.

So your one was not reported to SMS as well?
And before Increment, were you also above 35K ILR limit?

I was being paid £32K and got it raised to £38K. The increment was reported via SMS because it was a performance based raise, not an annual increment.

Be assured, there will be no problem. I had very similar situation during my ILR application when I realised my employer has never informed UKVI via SMS for any increment in last years, not even the big one's (performance based) I had twice, once was within last 6 months of ILR application.

Thanks for the reply, Mine is bit different, I was above 35K at the time of extension and thereafter got 2 annual raise, however not reported to SMS, let see what HO will say as ILR application is with them

was you above 35K already before getting raises?
Hope they'll not raise figures as these raises were not to meet ILR requirement. Let see what will be the outcome, Application with HO. Will post the update once I got.

There is no need to report annual increments. Also, since you were already being paid above the threshold, there would be no basis to suspect malpractice to meet the immigration rules. Therefore, I believe you're going to be alright.

was you above 35K already before getting raises?
Hope they'll not raise figures as these raises were not to meet ILR requirement. Let see what will be the outcome, Application with HO. Will post the update once I got.
Yes, I was above 35K before the final raise which I had 5months before my ILR application.

Finally Got ILR approval Letter. HO did not rais question on salary raise, I m sure they just check those who got increments to match ILR requirment

And Tier 2 employee is employer's requirement, it is the skill set they need, and the skill set holder can get job anywhere in world, that's why they are happy to bring in from anywhere in world.
