ILR after 5 Year but Dependent has less than 5 years in UK

Post by usmanakram_86 » Thu Jun 21, 2018 5:10 pm

Hi,

Currently I have Tier 2 (General) vise will expire on "14-Sep-2018" (My 5 Years are completed after 11-July-2018). So, I can Apply for ILR for my Self after "11-July-2018"

My Wife got Tier 2 Dependent visa on "10-Mar-2014" and she came to UK on (05-Apr-2014) applied for her exteded visa which expired on same time as mine i.e. "14-Sep-2018" which make 4 years in UK. So, her 5 years not completed so she can't apply for ILR with me.

My Daughter she born in UK on April-2016 (Applied for Tier 2 PBS Dependent - Child Visa from 12-Dec-2016 to 14-Sep-2018)

Questions:

1. If I Apply for my ILR Visa (by filling Online Set(0) form) can I add My Daughter as Dependent on same Form? (as my daughter only live in UK for about 2 year "she born in UK" )

2. for my Wife which visa should I apply?
I don't want to apply for any visa which reset her previous clock.
2.1 - Should I apply "PBS Dependent - Partner" visa for my wife? (which extend her stay for another 3 years as PBS Dependant)
2.2 - on "PBS Dependent - Partner" form online it is asking for "Does Mr xxxxxx have indefinite leave to remain or British citizenship?" I said "YES" for this, as I'm planning to Apply for my ILR using Premium one day service and after I got my ILR then I'll apply for my Wife.

2.3 - Is it possible to extend my Wife Visa as PBS Dependent? So, when she got her another 3 years visa and completed 5 Years in UK then I'll apply for her ILR visa in future. Is that possible/correct?

3. Should I apply my ILR before I apply for my Wife's visa? Or I can apply for her visa at the time?

4. Do I need COS from my Employer? as it is not a required document (when I complete online form for my wife but there is a question within the form i.e. "What is the length of Mr xxxxxx Certificate of Sponsorship (CoS)?" I answer as "3 years of less" Because previously I got COS for 3 years or less )

I have filled the online forms (My ILR (Set O) added my Child as dependent on same application and my wife's PBS Dependent - Parnter form online) So, it also asking for the documents "which is really good help when we apply using online form" (I have all the documentation which is no issue).

I just need help with above few questions after that I'll be ready to Apply for our Visas.

I really appreciate your Help.
Thank You.

You cannot include your wife and child on your ILR application form.

Your wife must apply on her own for a PBS dependent visa extension.

Do you plan on registering your child as British once you have ILR??

Thanks for your reply.

Then Should I add my Child on my Wife's PBS Dependent Visa extension?

I'm using this link to apply for my Wife's PBS Dependent Visa Extension
https://visas-immigration.service.gov.u ... nt-partner

Yes I wish to apply for British citizenship for me, Wife and Child after we all get ILR. (which I think we can apply once we hold ILR for 1 year?)

Thanks.

Once you have ILR, your UK born child is entitled to register and does not need ILR too.

Apply to extend your wife's visa once you get ILR if applying in person.

Register child on mn1 once you have ILR.

That's really a great relief, Thank you for your quick response.

Can you please confirm am I using the correct Online form for my Wife? (from the link which I sent in my previous post)

and what about question in my first post i.e. Q# 2.2 & Q# 4 ?

My Self:
I'll apply ILR only for my self in person (Premium Service)

My Wife
After I'll get my ILR I'll apply PBS Dependent visa extension for my Wife

My Child
Currently I will not add My Child to my ILR.
After I'll get ILR I'll apply british citizenship for my child using mn1 https://www.gov.uk/government/publicati ... n-form-mn1

Can you please confirm the above question/confirmation then I think I'm ready to go :D

Thanks.

Hi,

After filling the online form, it give me a list of Documents required.

one of the required document is
"
For the period before you were granted leave as
a Tier 2 migrant, documents showing that you
met the relevant requirements of the
immigration rules. For further information
concerning the evidence required, please refer
to the Tier 2 migrant policy guidance on our
website

"

can you please confirm what document required for above?

Thank You.

If you have only held Tier2 and that is what your ILR application is based then ignore this point.

Hi,

In SET (O) form (Online) I have a question "When did you first enter the UK? This is the date you entered the UK when the period of stay you are basing this application on started."

I Enter the UK on 26-08-2010 (Tier 4 Student visa Valid from 14-08-2010),
then I got my PSW (03-04-2012)
then I got my Tier 2 (General) (11-07-2013)
then I extend my Tier 2 (General) (15-10-2015)

So,
Which Date should I enter for above Question?

as my ILR Based on Tier 2 (General) so I think it should be the date of my first Tier 2 (General) which is "11-07-2013". Am I Right?

Thank You.
