I got my second Tier 2 PBS COS in Jan 2016 and it was valid for 4 years (valid until Sept 2020).

Recently I got a new baby boy, born in UK, and I did apply for a Tier 2 Dependent Visa for him (standard postal application) and I got his BRP yesterday (took 6 weeks, not too bad).

In the application for my son: there is a question saying what is the length of my COS ? Options were >3 year or < 3 year. My answer was > 3 year and I ended up paying £1408 instead of £704.

The BRP date of issue is 18/06/18 and it is valid till mid Sept 2020 as mine.

I phoned the home office today and could not get an answer and was told that I need to go on website to search for an address to whom I should write asking for a refund which ?

Any idea where can I get this address and any previous experience with similar situation ?

But your CoS is more than 3 years, so you answered correctly.

My COS was originally issued in Jan 2016 and at that time it was valid for more than 3 years. Based on this I got my current BRP as well as that of my wife and elder son. We all paid the visa fees for > 3 year which was correct at that time.

Now, we are in 2018 and I did apply for a BRP for my new babyboy, born in UK, and the validity of his BRP is < 3 year.

My question is were I supposed to pay £704 only which is for visa < 3 year or you think that I did pay the correct fees of £1408 which is the fees for visa of > 3 year ?

The exact question at time of application was “what is the length of Mr X COS ?” and my answer was > 3 year ?

Would highly appreciate your opinion,

Hi Dryasser,
I do not have an answer but I am in the same boat as you are in. However, I have not paid yet. I filled in the application and was puzzled to see the fees are £1408 rather £704.

Did you have an answer to share, please?

It is unlikely you would get a refund. The dependent leave is considered in line with the main applicant's leave and is issued for the same duration - not the length of time left on the main applicant's visa, although it does make sense in that the length of time they might get may or may not fall in the over 3 years category. I have seen posts where people claim to have paid the under 3 year fees for dependent child and got the visa although their own original leave was over 3 years
