Fiance visa and divorce declaration

Say 2 people are still legally married and they want to apply for the fiance visa, how far along does the divorce have to be in order for the application to be successful?

I feel once the decree absolute has been granted, from that date you are free to remarry.

Ben_9943, it basically needs to be guaranteed that the divorce is going to happen. So if the Decree Niisi has already been granted, and there is no Court Order stopping the Absolute being applied for, then it might be possible to apply for the fiancé(e) visa.

Actually, are we talking about a UK divorce?
