Consent order/Appeal and ILR

Hello Friends


I applied for Flr(fp) which was rejected by the H.O, then I went for JR. I have got right to appeal and have completed my 10 years in U.K. How do I apply for ILR? What options do I have in this case? If this is a repeat post please guide me to the right post.Thank you

What is your full UK Immigration history, including all relevant dates?

The process of JR is not part of the immigration rules or process, it is completely separate and does not give you Section 3C protection.

Arrived in UK on student visa in 2008

Applied for PSW which was valid till 2012

Applied for student visa which was rejected but got right to appeal which went on till 2015

Got student visa which was valid till 2016

Applied for Flr(fP) in 2016

Got rejection in flr(fP) without rigt to appeal

Did JR and got right to appeal 2018

You need to provide ALL the exact dates please if you expect strangers on the internet to offer any useful advice.

Dates include, visa start and expiry dates, dates of all applications, dates of refusal (and reason), date you submitted Judicial Review etc etc.

Applied for student visa on 30 Jan 2012 which was rejected July 2012 but got right to appeal which went on till December 2015

Got student visa which was valid from Jan 2016 till April 2016

Applied for Flr(fP) on April 2016

Got rejection in flr(fP) in August 2016 without right to appeal

Did Preaction protocol in September 2016 which was rejected

Finally went for JR in November 2016 which went on till May 2018

In May 2018 I received right to appeal and I have appealed.

My question is Can I apply for ILR under 10 years route?

No. You have not have leave to remain since August 2016, when your FLR(FP) was rejected. PAP and JR do not extend Section 3c leave.

Sorry I forgot to mention that after I after I applied for permission for JR and was allowed to proceed by the court,Home office offered me a reconsideration if I withdraw my case my case from JR.I withdrew my case and went for the reconsideration in which the Home office rejected again and issued me a right of appeal.

In April 2018 Home office rejected my case and I received right to appeal and I have appealed.
