Family visa the correct visa?

Morning All

First up, thanks for any help. My question is .... is family visa the right visa for my spouse and daughter? I believe it is...just wanted to get a second opinion to confirm.

Here is my situation...

I got the ILR in Dec 2017. I was on Tier 2 Gen prior to that.
My partner and daughter are on a dependent visa (Tier 2) that expires in November, 2018.
They are not eligible for the 5 year ILR route yet.

No it is not correct.

They can continue to extend their tier 2 dependent visas until they qualify for ILR. If you change to 'family visa' which is FLR(M), it will reset their clock to zero and a it will be a new 5 year route to ILR, 2 x 2.5 year visas.

Hi All

One more quick question.

I am now applying for Tier 2 (3 years) for my spouse and child as that will qualify them for the ILR.

For the NHS surcharge, I have combed through the boards and found that I should artificially manufacture the dates that give me the £600 surcharge (due to the lack of option for dependents who have partners with ILR).

Just wanted to make sure that this is still valid?

Yes it is still fine to do this to get the correct amount of £600 each.

Then you DEFINITELY don't get paid enough :)

One more question....how soon can I apply for the Tier 2 extension (for my dependents) prior to the expiry of their current leave?

There is no guidance on this on UKBA and I believe I saw a few comments on the boards that say you can apply anytime, as long as it is prior to the expiry of leave. So I am assuming if I apply three months prior to expiry of current leave, that should be ok. Correct?

Unlike ILR applications, there isn't any qualifying period required for extensions, apart from switching to unmarried partner. So, in your family's case, there are no grounds of refusal due to early extension applications.
