Good evening all. Just posting this to encourage someone at least. This forum helped alot during the whole process I was here almost everyday and some of the advise given to other people we also followed through Gods help.
My husband came to the UK on student visa in 2006. Then to PSW and then tier 1 general. I joined my husband in 2011 as tier 1 general dependant.
We both applied for ILR in February 2016. My husband had done 3 seperate tax amendments before we applied in February 2016. As the application process was taking so long and my husband had clocked 10 years and based on what I was reading here, we varied our application. My husband to 10 years ILR and myself to FM. As at the time of our application in February 2016, I was able to use my university degree certificate from my home country but the home office had stopped accepting that at the time we varied in October 2016. We have 2 kids born in the UK and the eldest had only 5 years continuous stay as at 2016.
We applied to the home office to send back my passport to enable me take the English exams but they only sent the photocopies which the center did not accept.
We received a refusal on both aplications in October 2017 with the right of appeal. My husband was refused due to the tax amendment and mine because I was depending on him getting ILR and the English language. We filed for appeal in November 2017 and got a date for May 2018. The judge granted in our favour and gave 2 weeks for the home office to react. It was 2 long weeks of prayers. Finally we have received our BRP cards this week. I have been granted 2.5 years on the 10 year route for exceptional cases.
The infomation I got on the board helped us decide to vary our application to the 10 year ILR so we could still have the right to work and get an appeal if the application was rejected.
