SET(O) Questions help

Hello All,

I will be applying for ILR on T1 ET (Promise) with leave aggregated on T2G. A solicitor has confirmed that this is possible.

I have been trying to fill SET(O) form and I have few questions:

1. Can I also include my wife as a dependant on the same form? Or do I need a separate form for her?

2. Since I am applying on T1 ET (Promise), do I need to complete 5.6, which I think is about T2?

3. What is the difference between 6.2 and 6.11? 6.2 asks about absences from the UK but it seems 6.11 also asks same information.

3a. About my absences when I was on T2G, do I need to get a letter from the employer? I was made redundant by that employer. Since then I have changed jobs twice.

4. In 7.14, what should I write about social and cultural ties?

5. In section 9, I just need to complete section relevant to T1 ET?

Yes you can include time spent under Tier 2G when applying for ILR under Tier 1 Exceptional Talent

Yes

No need to fill 6.11

Yes if your absences were more than 30 days in any residence year

Not that important. Write you have family ties back home

Thank you for reply.

If I go back 5 years from today, then I have in total 24 days absence when I was on T2G. In that case, do I still need the letter?

I have 33 days absence but that is after I switched to T1ET.

In the past 5 years, my total absences are 63 days.

Letter is not mandatory if the absence is less than 30 days and left with case worker discretion. But its good to have. Try with your employer,, If you can get it well and good. If not its not a show stopper in this scenario. You can just write this in cover letter

SET (O) Cohabitation proof

Hello All,

According to the new form published, it says the following about cohabitation:
If you have a spouse or civil partner listed in section 2 of this application form who is applying at the same time as you, please provide documentary evidence of cohabitation since you were last granted leave (up to a maximum of two years). Evidence provided should cover the whole period and be in the form of official letters or documents, addressed to yourself and your spouse.

Does it mean that if my and my wife’s visa was granted in Sep 2016, then I need to show cohabitation proof from that point onwards? Or should I provide proof for the past 5 years?

Employment gap cover letter

Hello All,

Between my two employments T2G visa, I had a gap of 75 days. I am aware that the 60 day rule has been removed.

Do I need to mention this when I apply for ILR?

If yes, then can someone please help me with cover letter wording about this matter?

Cohabitation documents

To show cohabitation, I have obtained council tax bills from cities where I and my wife lived earlier. I also have tenancy contract for all the places we have lived. Her payslips, credit card bills. Will it be sufficient?

Also do I need to show it for 5 years or 2 years? My leave was granted in 2013.

Letter on out of country leave for T2G

Hello!

When I was on T2G, I went out of the country to Italy. I left UK on Sunday 10th and reached Italy on Sunday 10th. Similarly, I left Italy on Sunday 17th and returned to UK on Sunday 17th.

When I request the letter from employer, which dates should they mention?

I am applying ILR through Tier 1 Exceptional Talent.

Probably best to have them make a list of absences and phrase it as "Date left the UK"/"Date returned to the UK".

ILR Success

Hello All,

My ILR was granted at Croydon!. This forum has been very useful and I just thought to share my story.

I had over 90 days gap between two T2Gs but luckily the rule was removed.

One day appointment at Croydon
ILR application under 5 year route

Documents:
Life in UK
UK NARIC documents for dependent along with original certificates
3 Months Bank statements (stamped)
3 month salary slips (stamped)
Employer letter
Tier 1 Endorsement Letter

Cohabiation for 3 years:
Council tax in joint names
Tenancy agreement in joint names
Wife's credit card statements, 3 per year

It took about 4.5 hours from registering the case to getting the decision.
