My friend has a problem, she came to the UK 4 yrs ago from Russia and got married in autumn 2005.Since then she had a child born in London (she was on a marriage visa on the time of birth) with her then husband (naturalised british citizen)and got her british passport two months ago. she is devorcing her husband now as he was not faithfull to her. Now she found out that her husband made a baby same time as she gave birth their her child, and bloke fell under a spell of that girl who happened to share flat with them and was her best friend.My friend is trying to get her child a British Passport but her husband is not helpfull at all- he does not return any calls, or mail or provides her with any support.
question is : How can she apply for a passpor to her child in this situation?
Is her baby a British Citizen, if not what she has to do?

    Yes, her baby is a British citizen. She would need to provide proof that she was married to her baby's father and he was British or settled at the time of her baby's birith.

    Best option is to write to the Home Office in Liverpool with details of her child, explain the circumstances, and ask them to confirm in writing that child is a British citizen.

    (assuming father became British before child was born).

    As father is naturalised, then the Home Office will have his details on file.

    There is no point applying to the Passport Office without either a copy of father's naturalisation certificate or some letter from the Home Office confirming that the child is British.

    Her Member of Parliament may be able to assist if the Home Office refuse to respond.

    thank you for this.will fathers copy(signed by notary pulic) of passport be enough proof that her baby is british?

    Was the father a British citizen at the time of his child's birth?

    Is the father listed specifically as the father in the birth records?

    If "Yes" to both questions, the child is a citizen of the United Kingdom without question. Documenting it then is only a matter of paperwork. Providing the fathers passport number would be enough, although other records and info (such as NIH#) would be excellent supporting documentation.


    If "No" to either question, then it becomes more a more 'interesting' situation.

    Sorry. Typo. I meant his national health insurance number. It is tied directly to his status as a citizen.

    With this number & his passport number, and the fact that he appears as the registered father of the child in the government records, there is no question about the child's nationality. Anyone who wants to investigate will find out immediately that the father was naturalized prior to the birth of his child ... end of question.

    It might be tedious to get all the paperwork properly filed (maybe not), but there is no controversy about the citizenship.

    Sorry I can't help you with the details on how to get it all in order; British paperwork is outside my expertise.

    However, the answer to your question is the child is British, and every time you need to document the fathers relationship, just provide the passport number plus anything else. The government records will satisfy any questions as to nationality.


    Next step ... if you wish ... is to take the father to court and get him to provide for his childs' welfare.

    Deadbeat fathers REALLY get my blood hot. Don't let him skip out on his child support responsibilities.
