CCJ effect on Naturalization application

CCJ effect on Naturalization application

Hi

1. I am going to apply for Naturalization with my wife as joint application.


2. I have been resident in the UK for at least five years .I came on spouse Visa in 2008 and now hold ILR more than a year.


3. My wife holds ILR from last 25 years.


4. We both are applying for naturalization.

5. I have the one CCJ on unpaid credit card and my wife has the two CCJ.

6. I have made arrangement with court to pay to bank on installment and my wife is dealing with court as well and bank to arrange installment.


7. Do we need to mention this on Naturalization application?

8. We are planning to apply Applying through the Nationality Checking Service (NCS).


9. Do we need to apply through solicitor or NCS service is fine in this situation.

10. The rest we do not have any criminal record or driving offence at all.

11. I am grateful if I receive guidance on this matter.

Yes declare them as they're civil judgements. As long as you are paying them back and you supply proof and neither of you are bankrupt then that should be ok. Try not to run up more debts and make sure an arrangement is in place for all CCJs. If you can't afford them send a N244 form to the courts showing your financial statement and what you can afford.

My debit in CCJ case is £700 and my spouse has more approx £5000 in one and £250 in one .

we are making monthly payment to these companies.

As I mention we are applying together.

Can I wait and clear debt before applying for Naturalization or if I apply in current situation can they make any issue on these CCJ.

Can you kindly suggest me your opinion on this.

You must ensure that you are actively trying to pay off the debts. Remember it's a financial crisis and we're all feeling the pinch. The question is, are you and your spouse getting debt with no real intention of paying them back? If so then you would be refused. However, if you're struggling like most in this dreadful economy and are trying to pay off debt and not getting more then this shouldn't indicate bad character and should not lead to refusal. Use the NCS and they'll ring the home office and get clarification on any potential issues. Just make sure you've got proof of paying the debts and write a letter of how you intend to keep paying and hopefully satisfying the ccjs after getting through the tough economic times.

I have one more question.

I lost my last month and currently looking for a job.

Can I put in job section that looking for a job / Unemployed .

If I put this then what will be the effect on my application.

As my spouse is currenlty not working because she is not well for some time.

Having a job is not a requirement for British citizenship.

Have you managed to get the Nationality. I am in a same situation with 2 CCJ and I have few months to apply for Nationality. Please advise.
