Right of Adobe travel

Post by raja1382 » Fri Aug 03, 2018 11:35 am

Hi,
Can you advise me on below situation

I am holding British citizen and my wife on ILR visa and currently pregnant. we are planning for baby delivery in India due to personal circumstances. we are planning to apply for ROA for baby after getting Indian passport and birth cert from local authorities in India.

1. can you confirm if below is link where ROA application is available? Pls confirm below -
go to https://www.gov.uk/right-of-abode/apply ... ntitlement
then go to select outside from uk - https://www.gov.uk/apply-uk-visa
then click on link in Apply for all other visa section - https://www.visa4uk.fco.gov.uk/account/register

2. I have got list of documents from other posts that need to be submitted for applying ROA for child.
just to be clear, as I am working in Uk during this ROA process, can i provide copy of British passport and original naturalization cert along with list of documents. can I confirm do i need to submit original British passport during application submission?

3. I understand that ROA duration will be provided until expiry date on baby passport ( 1.e., 5 years)
I am planning for my wife stay in India for some more time due to her health conditions, so would like to know if we can travel after 6 months or so. can you confirm if there is a time limit to travel to UK once ROA is obtained ? any specific timelines need to considered?

4. After coming to UK, what is process to apply British passport for baby as I would like to mover her from ROA. I tried searching in this board, but cant find it.

Please advise.

Thanks
Raj

No time limit. as right of abode is the same as BC, absolutely no immigration control.

any specific timelines need to considered? Only your wife cannot leave the UK for more than 2 years, or her ILR will expire.

4. After coming to UK, what is process to apply British passport for baby as I would like to mover her from ROA. I tried searching in this board, but cant find it. Just apply via passport office.
Checking service also provided in the post office (just don't know how profession they are, LOL)

Please advise.

Thanks
Raj
Just for your info. The ROA will stick to the Indian passport to your BB. So Indian side will know he/she is BC when your BB enters India again.

Thanks cyclina1.
It helps a lot to take decision in my case.
Once i apply British passport for baby after coming to UK, I will surrender Indian passport which has ROA and get OCI.
