Set M ILR

Post by Smalls16 » Sat Aug 04, 2018 9:50 pm

Can someone please help me with this absence section of the SET(M) spouse for for ILR

So September this here I would have been in the uk for 11year
-first 4 university
-5th post study work
-and the rest has been on the spouse visa

In the section below do I count my university and post study years in it or just spouse?

9.13 How long have you lived in the UK?
years month

AND

Please provide details of all periods of absence from the UK during that time:
Date you left the UK
Date you returned to the UK
Reason for absence

For the second question do I just list every time I'll left/returned in the uk in the last visa time granted (2.5years) or 5?

Please help

Which category of spouse visa, PBS dependent or spouse of settled person?

Are you applying for ILR based on 10 years long residence or 5 years on spouse visa??

Items of correspondence

Post by Smalls16 » Sun Aug 05, 2018 8:44 pm

Hi Everyone,

items of correspondence should be spread evenly over the whole period you are relying on - Is this for the last granted leave - 2.5 years or for the entire 5 years?

The last 2.5 years. One item every 4-5 months for joint correspondence as a guide.

URGENT - SET (M) Living and Absence Question

Post by Smalls16 » Tue Aug 07, 2018 10:00 pm

Hello,

I'm applying for my ILR on the 5 year spouse of a uk citizen.

I'm confused as to what to put for question below question

9.13 How long have you lived in the UK?
years month

Because I came to the uk in 2007 to study and did so until 2011; from there I went onto a Post student visa until 2013 when I started my 5 year spouse visa route.

The question I REALLY need help with is do i -

1. Count from 2007 to current as my length of time lived in the uk, and if how long back do I have to list "all periods of absence"

OR

2. Only count from when I started my 5 year route to now as my time lived in the uk and list just absences for the last 5 years or do I just do the last 2.5?

OR how to you advise I answer these questions?

PLEASE HELP

1. Count from 2007 to current as my length of time lived in the uk, and if how long back do I have to list "all periods of absence"

This depends on which route you're applying the ILR for. I assume in your case its 5 years on Spouse visa.

On 5 year route: You need to count your length of stay from the date of qualifying for ILR (28 days less than 5 years). So you would count this from sometime in 2013 to now. This route is called SET(O). In this route you're allowed up to a maximum of 180 days of absence in every 12 month period (Rules for this have changed for leaves granted from 11 Jan 2018 but it doesnt apply to you since your leave was granted before that) More details here: https://www.gov.uk/settle-in-the-uk

OR

2. Only count from when I started my 5 year route to now as my time lived in the uk and list just absences for the last 5 years or do I just do the last 2.5?

Last 5 years

Thank you so much for your reply -

So just to confirm what should I put for

"length of time living in the UK"

1. .10 years 11 Months ( this inudes the years spent studyingin the UK
OR
2. 4 years 11 months ( just counting from when I starts my 5 year spouse route)

- list my absence for the last 5 years regardless of above answer ?

Do I have to provide any documents for my absence other than just listing?

On the SET(M) it only has 4 spaces where to I fill out the rest as it's not enough space.

Hope someone and clarity things for me

This is not important as absences are not counted for a PBS dependant.

But state 4 years 11 months, enter the absence dates and no need for document for absence

OP is not a PBS Dependent. Set(M) ILR via spouse visa must list their absences.
