ILR Stamping or British Passport for baby born in UK

ILR Stamping or British Passport for baby born in UK

Hi All,


I have a situation as below and hope that I'll get some help here.

1. I'll be eligible for ILR in July 2008.
2. My baby is born in UK on 01/04/2008
3. She doesn't hold any passport till now.

Question is :

Should I apply for ILR for her with my application or just apply for ILR for myself and after getting ILR, apply for British Passport for my baby?

What's the status of the other parent?

If they're British or settled here then your baby is automatically entitled to a UK passport.

But something tells me its not going to be that simple..

Assuming the other parent doesn't have British citizenship or ILR (in which case child would be British already), you can register the child as British immediately after you get ILR.

Child should be included on ILR application pending that.

Regarding other parents, my wife is depenedent on me and she has got the similar status as of mine. Somewhere I have read that if you have PR and your child is born in UK then he/she is eligible for British passport.

In my case I'll get my PR (along with my wife) in July 2008 (Hopefully) where the child was born in April 2008. Obviously we are not PR holder when the child was born.

But till now I haven't applied for her passport in my country's high comission. So she hasn't got any passport yet. That's why the question was

Will she be eligible for British Passport just after we get our PR or she has to get ILR first.

The baby can apply for registration as a british citizen as soon as you have your ILR. Usually the baby's registration takes a about two months to process. Once that is done the baby can apply for a British passport, which takes about two weeks.

If you need or want to travel outside fo the UK during the baby's first year, you may want to consider applying for the baby's other passport and then the suitable residence permit for the baby.

We are from India.

I was thinking if I can avoid the hassle to get the Indian passport for her and directly apply for British Passport.

If I include her name into ILR application, then I believe I have to carry her passport for stamping?

BTW, how long it takes for the baby to register as british citizen who is born in UK and have ILR?
