switch of SOC from 2135 to 2137

Hi ALL,

I have got my new COS 2137 PHP Web Development now i came in 2015 which is having immigration based on PBS, i am a commerce graduate from Osmania, will this be considered now switch of new employement in Tier 2 or should now required to write IELTS please advice as i need to apply for the Visa

Are you changing employers ?

If there is a change of SOC, your sponsor will need to complete all the process like RLMT and Issue you with a Unrestricted COS .

I believe, you can use your English Language points scored on your initial Leave if you are using switching from existing Tier 2 Gen to New Tier 2 Gen.

If not, you may need IELTS or NARIC accredition

I Have another question; a change in SOC code will reset the Tier 2 continuos period.

Thank you so much my last employement salary was 39600, The New company i am joining now is giving 37600 as its Web Application development.

will there be a problem in visa as i am going for premium service next week and pls also tell me what are the documents required.

Tier 2 SOC Change and employer change applying for visa at premium centre last time i have submitted by Degree certificate as English language 10 points based on PBS now with April 2016 changes will i need this time NARIC to submit the COS application please advice


Previous grants of leave
164. You will be awarded 10 points for English language where you have met the English language requirement in a previous grant of leave. This will be the case if you have ever been granted leave:

• under the Tier 1 (General) category, Tier 1 (Entrepreneur) category or as a Businessperson or under Tier 1 (Post Study Work) category; or • as a Highly Skilled Migrant under the Rules in place on or after 5 December 2006; or • under the Tier 1 (Graduate Entrepreneur) category, having then provided evidence of having a knowledge of English equivalent to level B1 of the Council of Europe’s Common European Framework for Language Learning or above; or • under the Minister of Religion category (not Tier 2 (Minister of Religion)) under the rules in place on or after 19 April 2007; or • under the Tier 2 (Minister of Religion) category, having the provided evidence of meeting the English language requirement; or • under the Tier 2 (General) category under the rules in place on or after 6 April 2011, having provided evidence of having a knowledge of English equivalent to level B1 of the Council of Europe’s Common European Framework for Language Learning or above; or • as a Tier 4 (General) student, where the Confirmation of Acceptance for Studies used to support your application for that grant was assigned on or after 21 April 2011. If you are applying for Tier 2 (Minister of Religion), the Certificate of Acceptance of Studies must also have been assigned for a course of at least degree level study.

Transitional arrangements
165. You will be awarded 10 points for English language where you have previously been granted leave under Tier 2 (General) or Tier 2 (Sportsperson) before 6 April 2011 and you have ever been granted leave:

• under Minister of Religion (this is not to be confused with Tier 2 ((Minister of Religion)) under the Rules in place on or after 23 August 2004; or
Tier 2 Policy Guidance (Version 01/2018) Page 42

• under any Tier 2 category where you provided evidence of meeting the English language requirement.
166. You will be awarded 10 points for English language if you are applying for leave to remain under Tier 2 (General) and you have previously been granted entry clearance, leave to enter or leave to remain in any of the following categories:

• a Jewish Agency Employee, • a Member of the Operational Ground Staff of an Overseas-owned Airline, • a Minister of Religion, Missionary or Member of a Religious Order, • a Work Permit Holder, • a Representative of an Overseas Newspaper, News Agency or Broadcasting Organisation

AND you have not been granted leave in any other category other than Tier 2 (General), Tier 2 (Intra- Company Transfer) and those listed above under the Rules in place since 28 November 2008.

167. You will be awarded 10 points for English language if you are applying for leave to remain under the Tier 2 (Sportsperson) category and you have previously been granted entry clearance, leave to enter or leave to remain as a Qualifying Work Permit Holder and you have not been granted leave in any other category other than Tier 2 (Sportsperson) and as a Qualifying Work Permit Holder under the Rules in place since 28 November 2008.

168. You will be awarded 10 points for English language if you are applying for leave to remain under the Tier 2 (Minister of Religion) category and you have previously been granted entry clearance, leave to enter and/or leave to remain as a Minister of Religion, Missionary or Member of a Religious Order, and you have not been granted leave in any other category other than Tier 2 (Minister of Religion), Minister of Religion, Missionary or Member of a Religious Order, under the Rules in place since 28 November 2008.
