Hi, hope everyone is well!

I urgently need your help! I am new to this forum and I have some questions that I would highly appreciate if anyone can help with. I’m sorry if this has already been discussed.

I am about to apply for ILR under the new Spouse Visa rules. Any help is highly appreciated, wondering if anyone had a view on the following.

Q1. Qualifying Period to reach 5 years?

I had switched my Tier 4 student visa to a Spouse visa in 2013.

First Visa valid from 16-10-2013 to 16-4-2016 (by post)

Second Visa valid from 25-05-2016 to 29-11-2018 (by post)

(I had applied in April but there was an error on the form, therefore, we had to send it back)


My question is when will I qualify for 5 years?

What is the earliest time I can apply for settlement?

Can I use premium service appointment? If yes when can I start looking for an appointment?


Q2. Meeting the relevant financial requirement


My partner and I are on salaried employment, but struggling with the Financial Requirements element as it’s so confusing!

I am earning £17,238 a year (£1436.50 monthly) and I have been in the same employment since 2015.

My partner is on salaried employment part-time permanent since 2016 and her and annual salary roughly about £5,850 (variable)

Our biggest fear is that she left her job at the end of March 2018 but the company asked her to return in the following month (April) so she re-joined on 26th April 2018.

So she doesn’t have any pay slip in April 2018, however in the meantime she worked at another company (March to April).

April £520.55 (from another company)

From Current job

April £ 0.00 (No payslips)

May £475.02 back pay £67 total £542.88

June £475.02 overtime £31.32 Total £506.34

July £493 (basic salary increase) Back pay 39-22.62 (sick deducted) overtime £1.20, so totally £510.80

Please, can you clarify the following question?

8.3A Income from salaried employment

(xiv) What is your/your sponsor’s annual income from your or their current employment before tax (£)?

Q. Is this calculation is correct?

My annual salary £17238

My partner earning lowest basic pay £475.02*12=£5700.24

Work out my partner annualised overtime as (0+0+31.32+1.20+0+0=32.52/6)*12 =£65.04

So her total annual salary=£5765.28 correct or wrong?

Please I am desperate need of your help

*What is the earliest time I can apply for settlement? You can apply for settlement 28 days before the completion of 60 months in the UK under the Spouse visa i.e. in your case the 60 months are due on 15.10.2018 you count 28 days before that, and that's the soonest you can apply.

Can I use premium service appointment? If yes when can I start looking for an appointment?
Yes, you can, you should search for them NOW and if you are lucky you will find an appointment within the days you need it. As an advice I'll say try checking the website at 00:00 as then is when they release new appointments but bear in mind the appointments can be booked 45 DAYS in advance so people are rushing to get them

Regarding Q2. I can't give you advice I'm afraid.

Gosh your timeline is mirror of mine. I switched from Tier 4 to spouse 24/09/13. Got my extension on 24/04/16. Just applied for my ILR SET M yesterday.
