62500 pound gift?

62500 pound gift?

Hi All, some questions.

1-what if a UK national wife get 62500 pounds cash gift from her parents and keep it in account for 6 months. (She doesnt do a job)
and then apply for non UK national husband spouse visa? if this valid approach to get a gift?

2- as soon Spouse visa is granted , can she return the money to parents? if not then for how long it need to remain in account.
(Idea is as soon husband reach UK, he will start a job that can well earn about 30K to 40K to husband )

3- Since Husband is now earning by job in UK and UK national wife is house wife only, what will happen after 2.5 year when UK National wife re apply for FLR visa for non UK husband? does she need to show 62500 pound cash saving again? or earning made by husband that is placed in some joint account or in sole account of UK national wife will fulfill the requirement of earning?

or initially we show 62500 pound saving and after 2.5 years for FLR we should 18600 salary for wife ? ( no saving at 2.5 years )
will that be a valid combination?

I believe you would need confirmation from parents that this is a gift. If she needs to return the money then this is a loan! I guess there is nothing stopping you from doing this but the ECO may question a large sum of money being used purely for the application.

Once the husband is here his earnings can count towards the application for further leave. If the financial requirements are met through employment savings are not required.

If you are having your parents gift you such a large amount, you might want to check the UK tax laws to see if there will be any tax payable that might apply. There may be none but its best to check first.

hi guys. sorry to bug again.
here is how we planned it out as final layout.
uk national wife go back to uk.
transfer 62500 pound from parents account to her. pay tax on gift amount if any.
62500 will be pure as gift. and will remain in account for 6 month.
for living expense 6 month. parents will monthly transfer 1000 pounds on top of that for monthly expense.
after 6 months wife will apply for husband visa for uk.
and once husband is in uk he will find job and parents will stop transferring monthly 1000 support.
anyone sees any gotacha on this? only point i have is. does case worker raise concern that wife is not doing any sort of job at all and solely relying on parents? will that cause visa refusal of husband ? as wife dont have her own source of income? please suggest.

Where will your wife live? £1000 is not a lot when you have to pay rent, bills and living expenses, especially with children.

The accommodation would have to be sufficiently large enough to accommodate your wife, children and yourself without being overcrowded and you would have to prove this for your visa (which YOU apply for NOT your British wife).

You won't be able to include the 1,000 per month in the calculation as 3rd party financial support isn't accepted. You'll need to have the £62,500 in the account for at least 6 months before you submit the application. I agree with CR001 that £1,000 a month to support a family may well not be enough if you have to pay rent. What type of job is your husband hoping to get that will pay £30-40,000 a year?
Char, not that it changes anything, but the OP is applying for her husband to join her.
Edit!! It was a wife in the previous thread...not it's a husband "will that cause visa refusal of husband" :?

Thanks Casa, from the previous thread/posts, I believe the OP is the husband.

Edit : I hope they, both British wife and foreign husband, realise that the British wife will not qualify for any benefits with that level of "savings" and third party parental support.

Very confusing, :? I've just re-read through all the previous posts and agree it is the husband applying. Who's parents are gifting the money? I understood the wife's mother is a widow in poor health?

lolz. u all made me smile and amaze that you guys are very honest and caring.
yes i am husband and my wife is british and she is house wife living with me outside uk.
british wife will get 62500 pound gift from her parents that will be held in account for 6 months. 1000 will be added given to my wife from her parents per month for monthly expense. place to live is grand parents from whom we will get letter that place is sufficient to live (on side note , my wife parents have own house as well in uk that we can get vacate) so monthly expense not an issue.
only concern is will case officer be satisfied given the fact my wife doesnt have her own source of income and all support is provided from her parents?
( for someone asking what i do, i am IT engineer and i have international qualification which can hopefully get good job.)
please suggest is my case straight forward with above planning?

can anyone confirm if 62500 pound saving can be in bank out of UK ?
Also is it necessary for British national sponsor to be in UK for 6 months before applying ? can She be living outside UK and still eligible to sponsor her husband while planning to go back to UK together? ( i mean she can go to UK to Apply and then come back in a week? )

Any bank where the savings are immediately accessible.
Why would she go to the UK to apply? She is the sponsor, the husband is the applicant and submit the application from the country where he is resident.

thank u sir. previous idea was she will go work 6 month and do job.
so i thought for savings route she might need to be in uk for sometime.
so now all we need to do is.
fix the saving in my home country on bank account on her name. by the way we are in pakistan.
dont touch it for 6 months.
then i apply on bases of my uk national wife on bases of savings we have.
is that all ? sounds simple and unbelievable though :)
if anything else. please let me know. :)
