ILR Application held for Further checks

Hello Sirs,

i went to sheffield for my ILR one day services, provided all the required documents , did my bio matric and then after an hour or so, CW came out and provided me with standard letter saying that application is valid and we need to do further checks. CW also said that they need to contact my ex employer as i change my employer in Aug 2016 and he said that they also need to contact my current employer. He also said that they need to do some government checks as well.

Do you have any idea what kind of the checks they will go through? like they said that they will contact my current and ex employer. And also my ex employer is not into business any more and company is into liquidation.

i had an appointment last week 24 may and they said that check will take 2 weeks. will they take 2 weeks or they will take longer.

also the company was ceased to trade on 31st may 2016 and my notice eligibility was till 12th july 2016 and i got my tier 2 on 11aug 2016 with my new employer. Well i have provided all the letters to UKVI from the insolvency services and also letter from redundancy payments which confirm that company was ceased to trade on 31 may 2016 and notice was till 10july 2016. Do you think that covers my 60 days?

can you please suggest.

You need to tell us what visa you are on but I guess you are on Tier 2. When did you first employment terminate and when did you apply for the new visa with the current employer ??

Any sudden, large salary increase just before applying for ILR?

Hello,

Thank you for quick response. I am on tier 2 and i got an email from my existing employer on 31 may 2016 that the company is ceased to trade and notice was till 12 July 2016. I applied my tier 2 on 11 aug 2016 with my new employer. Ex employer cancel his sponsor licence in Nov 2016.

And yes the salary was increase last year in month of December 2016 with my current employer and that is not coz of ILR, that is coz i told them that if i don't get paid £36 k then i wont be able to stay and i wont be able to extend after 6 years and also initially when i join my new employer, i ask them to pay me £35k and they said that we will review the performance and will do that after your probation period.

i was on £26 k and got increment for £10k , so i am getting £36k for now. So for the past 5 months, i am getting paid £36k.

Please suggest.

i applied my tier 2 on 11 aug 2016 in Birmingham one day service and got the desicion on same day but my bio matric issue date says 23 aug 2016.

You have received 38% increase on your salary which is a huge spike, just several months before your ILR. :!:
That means your sponsor will be investigated and questioned. Your sponsor's license could be revoked if they are found that they tried to enable you to get ILR.

well my sponsor did upload the letter on SMS in January 2017 informing same to them as well.

do you think will that work or do you think they will visit my employer? if they do visit, my employer is happy to answer all questions and explanation.

my employer is not trying to help me to get ILR, initially when i join them i ask for £35k and they said that they will increase after reviewing my work.

please suggest what do you think.

I have just check with my employer and they said that, they did uploaded the increment letter on SMS on 8th march 2018. So they did notifiy HO approx 3 months prior applying to ilr.

Just wantet to ask, will UKVI will visiting my emplyer for sure or they will be writing to them askin for the reason for salary increment ? How much % chances are there that will visit my employer ?

Please suggest.

38% hike within the company definitely raises an alert. A hike of 10% is really good in UK and are lucky if you get that .38-40% really sounds something fishy to ukvi unless you are changing employment.

Any significant change should have been updated in 10 to 15 working days. In this case,it seems nearly 3 months which ukvi treats as sponsor not fulfilling his duties responsibly

I dont understand that why UKVI think from their point of view. I have been working for past 7 year and with my previous employer i worked 6 years with the same salary and he never wanted to give us a hike as they know that i cant do anything asen i am stuck into something and get out and they can use as the way they want to. Company was milking money but was not happy to pay us. I did ask every year to give me a hike but always given an excuse.

And now i got an employer who agreed to pay me but they said that after reviewing my work and which they did. I have been working for past 7 years and have good experience and i think i deserve the hike. what UKVi want that people working in their country shouldnt be earning that much.

UKVI rule book dosen says that you cant have a hike of 38%, if you did get it then we wil not issue you ilr. if they have doubt then is their problem and they can do checks the way they want to. The rule only says that the time you apply for ilr , your salary has to be £35k and now they need an explanation y i am earning that much. They should have mention in t heir rule book that if u have sudden hike then they need explanation.

I understand that my employer didn't updated the SMS in 10-15 working days, coz they are new to the system and they wasnt sure about the procedures but they did it but later. IF UKVI want us to think from their point of view, so also need to think from our point of view.

Anyway i am not trying to be rude here and i know its UKVI and we cant do nothin, but they need to considered everything.

Thank you again and i can only wait and see what will happen now.

yes my company got the compliance visit.

Saima123 - if you are expecting a compliance visit, then in your interview make sure stick to your cos. they just want to know that are you doing everything which is on cos or not.

Thanks for reply. yes my company also got compliance visit and we got A rating after. but still no updates on my application. waiting for decision and its been 4 weeks since the feedback.

Saima if sponsor lincse is not revoked or suspended then u will be getting ilr for sure soon..

hello,

apologies, i wanted to updated to the post but i couldnt able to find the post.

i did get my ILR in mid of april and i want to thank you all the experts who helped me and honestly their advice was grt help.

just to give you brief, i applied in may 2017 one day application, application was on hold for further checks. visit happen in june 2017 and then got reply in dec 2017 that sponsor licence has been revoked. w submit the representation on jan 2018 and got the reply in march 2018 and licence has been re instated and then got my ilr in mid april 2018.

thank you all again for all the help and grt advice
