Extension approved after 17 months

Extension approved after 17 months

By the grace of Allah Almighty I got my extension approved and was finally end oh the long waiting of 17 months. Thanks to this foroum it really helped me out and all those who shared their valuable knowledge , information and experience. My next step is preparing for ILR which is due on 27 of March 2019 as my previous grant was till 27 March 2017. I've got some questions here relating the employment,it is highly appreciated if some one help me out with.
I've got one employee through out the waiting period and will be continued till March 2019, so it's clear with employee A.
If I hire employee B from now, till March 2019 it makes 7 month so my question is how can I make up this 12 months employment? Should I hire employee C for 5 months as well? Inorder to apply before April 2019.
My second question is : if I apply after April 2019 then what are the implication for me in my case, my initial grant was in March 2014. Thanks

Yes, if you want to apply before Apr 2019, you need to hire two employees.
After April 2019, you will have to wait until Aug 2019 for your second employee to get to 12 months also

I would ask a little more details plz, in case I apply after April 2019 should I keep same employee for a continuous period of 12 months or can I do two employee for 6 months each? Can you sent me please the link of employment rules change for after April 2019 applicants. Thanks

Applied 25/03/17
Biometric 20/04/17
Complex letter 26/04/17
Interview in my office 8/11/17
IHS refund (partial) 27/06/18
Approved 08/08/18
Received documents 24/08/18
No MP was involved. I just called once myself in May 2018 and then got a letter in July saying that application has not decided yet and asked to wait.

You need to keep two JOBS for 12 months each. The number of employees is immaterial.

I don't have the changes link at hand, but just look through the latest T1E guidance - it is clear there.

Hi

Congratulations for the approval Khaky.

I was just going through this post and just wanted to clarify myself that as marcnath agreed that you need 2 more employees if you want to apply before April 2019.

My understanding was that 24 months of employment is needed once the visa is approved. So how come the 17 months are getting counted on this occasion.

Also if ILR is applied after april 2019 then both the jobs should last for at least 12 months??? Is that understanding correct??

Please correct me if I am wrong. Its a bit confusing.

Can you please shed some light on this?

Howcome 17 months are getting counted on this occasion?

I was under the impression that the employment timer resets once visa is approved and 24 months employment has to be shown after the approval date.

It can be any combination if the person is under transitional arrangements which will end in April 2019 however after that the job needs to exist for 12 months each.

Kindly advise me on this.

Not clear which 17 months you are referring to ?

The only reference to 17 months I can see is the time between the OP's initial application and approval - nothing to do with job creation

like Khaky mentioned in his initial post that he has got the visa approval. During the time his extension application was with Home Office, he had 1 employee who was employed continuously for 17 months. Now if he wants to apply before April 2019 he will need another FT employee for 7 months.

So will that continuous employment of 17 months count towards job creation criteria of 24 months - which will make him eligible to apply for ILR along with LIUK test?

He clearly asked if he needs a third employee, to which I replied yes - he needs to employ two more. Together, the 2nd and third employee will make up 12 months, while the first employee will provide 12 months.

But if he has received his visa in Sep and wants to apply before April 2019 how are you counting the 12 months job creation?

Doesn't the employment counter resets after receiving the extension?

My understanding was that you have to create 24 months employment after getting the extension approved.

Am I correct or please illuminate! :idea:

Under the changes made at the beginning of this year, you can use jobs 12 months before the application date, even if part of those 12 months is before the extension approval date. So, if OP is applying end of March 2019, job created from April 2018 can be used.

If someone is applying in March 2019, ANY employment created between April 2018 and March 2019 can be used. Employment before April 2018 CANNOT be used.
