Retained ROR, expired residence card in the middle of divorce

Hello, I need some advice.
I'm a non-EEA getting divorced from my EEA spouse.
I received my residence permit nearly 5 years ago.
A year later, we left the UK for over two years, and returned in 2017.
We started divorce recently. The problem is that upon our return to UK in 2017 and until after start of the divorce proceedings my spouse hasn't worked. He works now, but how I understand, for me to retain ROR, he had to excersize treaty rights when divorce proceedings were initiated.
Is it correct?
Another issue is that my residence permit expires next month, and I won't be able to work until decree absolut.
What are my options to retain ROR?
