Post by DeepThroat » Tue Mar 08, 2005 4:33 pm

A lot of people are waiting for email query from HO, this is what I received

________________________________________________________

Thank you for enquiry about Further Leave to Remain (FLR):

Unfortunately, due to an unprecedented level of requests for information by
e-mail over the last few weeks, we are currently unable to provide you with
a personal response to your query, as we would normally do. We have
therefore complied a list of "frequently asked questions" that we hope will
address your query.

You can up obtain weekly updates on our processing times from the 'News' and
'Announcements' section of our website www.workingintheuk.gov.uk.

Applications will not be allocated to caseworkers for assessment before this
date. We would therefore request that you do not contact us for a progress
check until the In-Country Team has reached the date you sent your
application.

public callers)

1. What is an IED?

IED stands for Immigration Employment Document and this is your Work
Permit, Highly Skilled Migrant Programme (HSMP) status, Training or Work
Experience Permit. Sector-Based Permit or SAWS card.

2. When do I apply for Further Leave to Remain (FLR)?

You may apply for FLR before or at the same time as your application
for employment is submitted. However, if your application for employment
fails your application for FLR will also fail and you will not be entitled
to a refund. In all circumstances you should submit your application for FLR
before your current leave expires. Please be aware that to extend your HSMP
you are only required to apply for FLR but this application must be made
before your current leave expires.

3. How do I apply for FLR?

You are required to complete an FLR(IED) form enclosing a £121 fee
and documents requested on page 10 of the application form. Please be aware
that these documents must be the originals.

4. Where do I get an FLR(IED) form from?

You can download a copy from our website www.workingintheuk.gov.uk
using the 'All Forms' link on the right hand side of the homepage.
Alternatively, you can call our Distribution Centre on 08705 210224.

5. Where shall I send the FLR(IED)?

The FLR(IED) form should only be sent to the address below:

Work Permits (UK) - FLR(IED)
Home Office
Walsall Road
Cannock
WS11 0WS

You cannot send the FLR(IED) form with the Work Permit application
to the same address.

Please send the work permits application form to our payment
processing site at:

Work Permits (UK)
P.O. Box 551
Doncaster
DN1 1XU

6. Will I receive confirmation of receipt?

Once we have processed the £121 fee you will receive a letter
confirming receipt of your application and your payment reference number
which will start with 'LT'. If you do not receive a letter you can confirm
receipt by tracing your delivery number using the Royal Mail's Track and
Trace facility on their website www.royalmail.co.uk.

7. What if the Royal Mail confirms receipt but £121 has not been
deducted form my account?

In these circumstances it is likely that there has been a problem in
processing your fee. Your application form will be sent to the In-Country
Team who will return your application form requesting that you re-submit it
to Cannock with a new payment. Once your fee has been cleared the
application will be sent to WP(UK) In-Country Team who will process your
application.

8. What if I need my decision and passport urgently?

We recognise the difficulties caused to customers by the current delays in
processing further leave to remain applications linked to in-country work
permit cases. As a consequence arrangements are in place to deal with
applications quickly where an individual needs their passport (e.g. to
travel abroad for pressing personal or business reasons).

If you have exceptional circumstances such as the need to travel it is
possible to make a request for your application to be treated as urgent.

To make an urgent request please complete an Urgent Treatment form and fax
it to the relevant In-Country Team or to 0114 259 3357 once you have
received confirmation that you payment has been processed.

You can obtain an Urgent Treatment form from our website
www.workingintheuk.gov.uk using the 'All Forms' link on the right hand side
of the home page. Please do not submit more than one form.

When an urgent request is accepted the In-Country Team will do all they can
to ensure that your request is serviced by the required date. However, as
we receive a large number of these requests there is no guarantee that the
In-Country Team will be able to process your application at short notice.
The In-Country Team processes applications depending upon the date the
passport and decision is required. Therefore, if you submit an urgent
request well in advance of your date of travel your application may not be
processed until a short time before.

If you only require your passport and not your decision please fax a letter
to the relevant In-Country Team asking them to withdraw the application and
return the passport.

9. Can the overseas national work while the application is being processed
if they are already living in the UK?

If you have been issued with a new work permit you can not start working
under the conditions of that permit until you have been granted Further
Leave to Remain (FLR) to do so. However, you may work while the FLR(IED)
form is being processed if you have valid leave to remain in an immigration
category that allows you to do so.

For example -

If you are residing in the UK on a Working Holiday Maker Visa or a
Permit-Free Training Visa, you can continue to work in the UK until a
decision is made on your FLR as long as the work permit application and the
associated application for Further Leave to Remain on the FLR(IED) form is
received before the expiry date of your visa.

We are aware that the Further Leave to Remain delays are causing particular
difficulties where existing work permit holders wish to move to a new job
within the UK.

We are therefore introducing an interim arrangement whereby existing work
permit holders can start a new job on the strength of the work permit
permission letter, providing their existing leave to remain covers all or
part of the period of the new employment;

In these cases individuals will then have to submit a further leave to
remain application before their existing leave expires, or within 6 months,
whichever is the sooner.

As the employer's work permit will have been approved, and the individual
will still have to submit a further leave to remain application, this does
not undermine immigration controls in any way.

i dont think they have changed anything in terms of which applications they are clearing first, its still the last in first out method. What they dont realise is the fact that they have only moved 1 day for FLR since xmas, thats coming to 3 months now

Ayesha, that is a very interesting point. I don't think it's legal for them to disconnect that phone but it's not normal that there is literally noone in the forums that could talk to them in the last days (or am I wrong?). Very discouraging..

Saint,

You are right, It is not legal for them to disconnect the phone but yes, the number is always busy. I remember, when I applied for my FLR in september last year, I tried for four days continuosly before getting the HONOUR to speak to them. So, my advice is keep trying and you will get through.

Kumar,

I think, you have received your Ack. by post recently. And it is too early to chasing them by phone unless otherwise you need ur psaaport very urgently, i feel.
