TIER 2 to ILR - complicated

Post by Sam61691 » Sun Oct 14, 2018 10:36 am

I have a query here ..if anyone could help ..I came here in Sep 2012 on student visa got tier1 E from 31december 2014 till 31 December 2017..my tier1 E visa was curtailed in May 2015 with right of appeal which was allowed in April 2017...i tried contact home office for further action but they never get back to me ...in January 2018 HO get back to me and said my visa been expired..so within 14 days I applied tier 2general visa which I got ...now I'm pragnent ..have worked for my employer for 6 months and then gone on my maternity leave for 52 weeks...my question is whether I'm eligible for ILR on completing five years..currently I'm getting 27400 per annum ..do I have to be on minimum salary threshold till next January if I'm eligible for ILR which will be 35400 bcz I would have worked for my employer for one year if I exclude maternity leave so I'm not sure if I would b able to gain this much raised pay ..plz reply to my query I will b grateful

If your job is not in the shortage list or PhD level job, you have to meet the threshold. And your salary now is far below from the threshold, this is impossible to meet within a year normally. So you cannot apply ILR. Even your employer gives you the pay rise, the home office will be suspicious and likely your ILR will be rejected if your employer cannot justify the pay rise.

If you apply within 4 months of salary raise, just above the threshold, it will almost certainly raise flags/suspicion in home office.

I would advise to wait for 1 year or so before you apply with new salary and also get letter explaining the salary rise from your employer.

Thank u so much ..my visa is till april 2020 and m elligible to apply for ILR on or after 3 december 2019. if my employer will give salary of experienced employee from july 2019 is that fine if i apply for ILR in march 2020 instead of extension...or one cannot wait for ILR that much long ..currently im on maternity and will b back in july next year...
