Tier ICT to Tier General

Apologies if this is a repeated query.

Situation is two spouses, one was on a Tier 2 ICT from May 2013 to May 2018. The ICT dependent spouse then obtained Tier 2 General sponsorship from August 2018 to August 2023 (when qualify for ILR). The spouse who had the ICT is back working in the UK as a dependent on the Tier 2 General.

Can this dependent spouse ever get sponsorship for themselves given they did not spend the 12 month cooling off period outside the UK? So basically is it just 12 months without sponsorship or does the spouse have to physically spend 12 months outside the UK in order to get their own sponsorship after having a 5 yr ICT?

Also maybe Brexit is a good thing if it will change this rule!
