The Home Office has conceded at the Upper Tribunal, that it is arguable that in as far as the EEA regulation 2016 refuse and continue to refuse right of appeal to Extended Family members, the EEA Regulation has failed to give effect to the EU law. The Home Office accepts that Permission to apply for Judicial Review must be granted in the case.
The question is, why can they not simply amend the damn regulation to make it compatible with EU law.
Extended family member who have been refused rights of appeal, must lodge an application for permission to apply for JR on that basis.
