Changing SOC code under same visa

Post by syesild » Tue Nov 13, 2018 10:28 am

Hi,

I have Tier 2 ICT visa for 5 years (29.08.2015 - 05.09.2020) and I'm already here in UK since 3 years 3 months. The company where I'm working for and myself decided to change my position (step up) to get more flexibility in work. My current SoC code is 2136 (software developer). New one would be either 2134 or 2424 (Project Manager).
My questions are;
1 - Can this SoC code be change under my same visa?
2 - Would this affect my ILR application in the end of 5th years?
3 - If HO refuse this application, would this affect my actual code and actual visa duration?
4 - When my company applied for my visa min. annual salary was 41K where they agreed on this. Is this increased now or still same?
5 - What would be your advice that we need to be careful when we want to start on this process?

Thank you in advance!

Best Regards!

Tier 2 ICT does NOT lead to ILR.

Hi,
There must be mistake I guess. Here is the answer from gov.uk website.

Could you please update us accordingly.

https://www.gov.uk/settle-in-the-uk/y/y ... nsfer-visa

Note: Bold ones are what I have or will have.

Eligibility
You can apply if:

you have a Tier 2 (Intra-Company Transfer) visa
you’ve been living and working in the UK for 5 years and spent no more than 180 days outside the UK in any 12 months (known as ‘continuous residence’)
your employer (sponsor) still needs you for your job
you get paid the relevant salary listed in the Codes of Practice

To qualify, you must have had at least one of these visas in the 5 years:

Tier 2 (Intra-Company Transfer) issued under the Immigration Rules in place before 6 April 2010
Work Permit for an intra-company transfer

You can have had any combination of these visas during the 5 years:

Tier 2 (Intra-Company Transfer)
Work Permit in the business and commercial category or the sports and entertainment category
Representative of an Overseas Business

If you’re 18 to 64 years old when you apply, you must also:

pass the Life in the UK Test
meet the English language requirements

Thank you!

You are not reading it properly.

If you got your tier ICT visa AFTER 6th April 2010 then you cannot apply for ILR based on 5 years residence.

Only ICT visas issued before 6th April 2010 qualify for ILR.

These has been cleared multiple times before
uk-tier-2-employer-sponsored-visas/tier ... 61223.html

ICT after 6 April 2010 is not a settlement visa and Workpermit ceased to exist since 2008
