Impact on my Tier 2 application process if partner claim Child Benefit

Post by dc10mhr2013 » Sat Nov 24, 2018 5:25 pm

Dear Members,

I am planning to apply for Tier 2 General Visa (Switching from Tier4). However, my wife is on ILR and she is claiming Child Benefit. Will it impact on my Tier 2 application process? How should I answer to this question: ‘’Have you ever received any public funds (money) in the UK?’’ -YES/No

Many thanks in advance.

No issue. She is allowed to claim. You are not.

Many thanks for the quick response. Just to make sure Should I answer No? Or shall I answer Yes and explaining the reason. Your advice will be highly appreciated.

YOU are not claiming.

Your PARTNER is not applying for a visa.

Why are you applying for Tier 2 and not a spouse settlement visa if your partner holds ILR??

Hi

Initially, I was planning to apply for spouse settlement visa but currently, my spouse is on maternity leave and she asked for three months unpaid holiday. Last six month I have been working as a part-time (20hrs/week) Research Assistant with an annual salary of £17,842.14 but which is below the £18600.00 threshold. Got a job offer from a company (Tier 2 A rated) and they are going to assign me a UCOS letter very soon. Also, I will be eligible to apply for SET(LR) on 28th of January 2019 and my current leave (Tier 4-DES) will expire in June 2019. Any advice on this regard will be appreciated.

Many Thanks.

So why not simply wait till you can apply for ILR instead of switching visa and paying Ihs and visa fees??

Hi

I fully agree with you. But the main issue is the company- wants me to start the job ASAP. They have been dealing with this matter since July 2018. They will cover my VISA cost as well. Also, don't want to miss the job opportunity.

Many thanks for your kind advice.
