Switching to Tier 2 General from Tier 2 ICT Dependent Visa

Post by Abhinavsetu » Sat Nov 24, 2018 7:15 pm

Hello,

I have a small query : Am currently working in the UK on Tier 2 ICT Dependent Visa since last 6 months with a firm , who is willing to sponsor my visa. So, can I apply for Tier 2 General Visa from the UK or it can only be applied from home country? Please help.

Also It has been 1 year since I came to the UK on dependent Visa.

Also what is the difference in restricted and un-restricted CoS ? Does it impacts on the visa application location. (Within/Outisde UK)

Regards..

No, you cannot apply to change to tier 2 general within the UK. You must apply from home country.
Also It has been 1 year since I came to the UK on dependent Visa.
This is irrelevant how long you have been in the UK.

Unrestricted CoS - for applications WITHIN the UK to extend tier 2 or change employers.

Restricted CoS - for applications OUTSIDE the UK, RLMT required if non shortage occupation.

Thanks a lot for quick reply.

So, only un-restricted CoS holders can apply from the UK , which i belive has a higher minimum salary requirement?

Regards.

No, why do you believe that or where did you read that?

To get a Tier 2 General visa, you need to be earning a minimum of £30,000 per annum OR what is stated in the SOC, whichever is HIGHER.

Ok. Great.

Really appreciate your help in clearing the confusion.
Just a final query:

So, after getting the sponsorship certificate , I belive it will be ok to continue working from the UK and fill online application for Tier 2 General Visa and then travel back to home country just few days before the booked appointment date , so that there will be minimum impact on the employer's business.

Should be fine yes.

What is the SOC and salary you are being offered?

Have they completed the full and proper RLMT on the required portals for 28 days to prove to HO that there is no settled, British or EU citizen to do the job and that you have not been 'pre-selected'??

Thanks.

The SOC code will be 3535 as per discussion but am not sure about the minimum salary requirement for this. Can you please suggest ? This will help me in further discussion.
