Switch from T4 student (dependant) Spouse to T4 Student (main)?

Post by asha-hussain » Sat Nov 24, 2018 1:58 pm

Hi,
I’m new on this forum, I'm confused and really need help please...

Husband on T4 student visa
I am on spouse (dependent) visa
1 child born in the UK (now 6 yrs. old) on dependent visa

Soon completing 7 years on student visa so I guess he (My HB) can't apply for any further extensions !
So what’s next?

1: Can I apply for student visa (as main applicant) from home country, and my husband (who is on student visa) will move to spouse (dependent) visa so we can complete 10 years to qualify for ILR or may be make child 7-year application in the future.

2: Is this possible?
3: Will it count towards continuous 10 yr residency?
Please explain in details if possible.
Thank you all in advance for your help

Yes its possible but make sure to return within 6 months to keep continue the long residency.

Thanks for the reply but some solicitors said, as you are applying and coming into the UK on a different visa your clock will reset !!! is that true?

No it is NOT true for ILR based on Long Residence continuity of residence.

that's good news :) thanks.
Are you aware of such a case of switching T4 visa category?
How likely is it to get a new T4 student visa after spending nearly 7 years in the UK as a T4 dependent and working full time?
I'm trying to get two things out of it, a UK degree and 10 years of long residence.

Was he/she really a solicitor? Have you checked that?
