Pre 6 April 2014 transitional arrangement clarification

Dear Members,

I need some clarification for the pre April 2014 transitional arrangement -- job creation.

As per the policy guide:

Pre 6 April 2014 transitional arrangement- job creation
If you successfully applied to enter and have continually remained in the route since before 6 April 2014, and you are making an extension application or a settlement application, you may continue to employ (and score points for job creation for):
• 1 worker for 24 months
• 1 worker for 6 months and one for 18 months
• 4 workers for 6 months each

Question 1 : Do we have to have job as per the above exact number of Months ?
Question 2 : Let say if we have 1st FT employee for 13 months , 2nd FT employee for 10 Months and 3rd employee for 2 Months . Can we count all these month altogether 25 months ?
Question 3 : let say if I have one part time employee for 4 months . can I count this as 2 month Full time job?

any advice will be greatly appreciated.

Of course not. It’s an example. Can be any combination.. so NO

Answered this before and answering again YES. Also the required months is 24.

Question 3 : let say if I have one part time employee for 4 months . can I count this as 2 month Full time job?

NO. Simply coz the guidance states 2 part time jobs can be combined with each other to make a full time job.
a single part time job can’t be combined with it self.

Though I’ve seen someone get it but by virtue of total number of hours but I wouldn’t suggest you to take the risk.. when you already have enough.

24 months or 104 weeks
Any number above 30hrs/week is disregarded Anything below 120hrs per month is considered part time
Dear Aman and other members.

I had long conversation with my solicitor regarding the employees hour but I am not satisfied with his statement and clarity on hours (I think he is not even sure). He has suggested me to use employee 4,5 and 6 as well and it makes the employee hours sheet complicated .Employee 3 left and than 4 left in small period and I can't use some month hours as its below 120.

I am thinking to use employee 1 , 2 and 6 only to make sheet simple and clear. As you suggest me to use employee 6 - December payslip and add up 1 more month to complete 24 months.

Employee 1 -- 4 months
Employee 2 -- 6 months
Employee 6 -- 14 months (including December payslip)

is that alright to use only these employees ?

And employee payslip and RTI does not show the employee number of hour. so in this case I need to provide them employees contract. (Any suggestion to mention employee hours)

Easier ways to confirm hours than contract.
1. Job table- online application
2. Payslips- hours confirming wage rate.

The caseworker should calculate hours based on salary, age and minimum wage requirement of the period.
You could also:
3. Draw a table- detailing names, wage rate, number of hours per month, any changes in minimum wage during the 12 months.
Minimum wage changes every April so check before and after according to age of employees unless you pay over above required minimum wage.

By- ADD the DEC18 RTI FPS for Dec 18 of employee 6 and it’ll be perfect .

I will claim only these employee including December paylisip.

My account is saying that if we add the number of hour on payslip than it come with some discrepancy and need to be adjusted as all staff were calculated by Annual package. shall i show the contract papers ? or any other suggestion ??

Ur accountant being difficult. Coz below is how it’s calculated.
Salary per month on payslip divided by wage rate= no of hours per month
E.g
Payslip-£1000/wage rate 7.83= 127.71 hrs

No contract necessary.. too much information.

What start date for employee 2 did you send to HMRC?
Was emp 2 mentioned on RTIFPS for JAN 18?

Yes we did inform HMRC that employee 2 start was in Jan and its on RTI as well.

The annual package is irrelevant and is not part of the payslip. It’s part of the contract.
Are the amounts the same on both RTI and payslip?
Also be very careful of accountants.
I requested my RTI FPS from my accountant and he sent me an employers summary which is inadmissible.
Don’t totally trust ur accountant or any solicitor.
Use ur mind as at the end of the day or it’ll be you who will suffer not them..

That’s it then.
On the application the employee 2 or in fact any employees start date will be the start date sent to HMRC.
For fulfilling requirement of hours just the relevant payslips. I’ve mentioned the ones you should give. The figures on the payslip must correspond to RTI FPS of the same month.

The payslip doesn’t necessarily have to state the hours or even the wage rate. It’s just eases calculation for both you and caseworker.
You could draw up a table and as I mentioned earlier as well if you don’t want the hours n wage rate mentioned on the payslip.

PAYE reference letter is not important
Sine your business is on RTI then you obviously registered.
Ask ur accountant. You probably gave it to him or he registered for it.. if he handles ur payroll as well..
Did you not submit it at time of extension.. you must have some back up..
I tend to scan all documents.
